The first\nresponidlentffi 'holding the post of Junior\nAssistant.,!  against the post of\n\nAssistant Tfaffie lvfianlager, under the said scheme.\n\n to the appellant before this Court,\n\nres.po'ndeifi--iij_ was not eligible for appointment to the\n\n post Dfa;A.ssistant Traffic Manager, on account of the\nA f\"eligi\"oility eriterion laid down in the scheme. In this behalf,\nT   would he pertinent to mention, that the eligibility'\n\n criterion, inter - cilia provided as under:\n\n\"T he employees who apply for these posts, under this\nseheme, should not have been imposed with penalties\nspecified under the Karnataka State Road Transport\nCorporation Servants [Conduct and Diseipiine}\nRegulations lg?   rnentioned 'below:\n\n{a} l8A iiii\u00e9 to gviiii\n\n\n\nX'\nr . it\nit\n\n<5'\n\n'g: E\nif? \n F\n"f5\n\n\n\nWm.W.....\n\nxlai\ufb01\n\n6\nhearing of the instant writ appeal.\n\nThat being so, the non\u00bb\nconsideration of claim of the first respondent during the<\/pre>\n

   ejndige did not hold, that the first respondent<\/p>\n

l\ufb01have been appointed as ‘Assistant Traffic Manager’ (on the
\nv”‘lf_deelaration of his suitability to the said post), even though
\n  said determination rendered by the learned single<\/p>\n

the first respondent; We are ef the View that the equities<\/p>\n
