Respondent Nos.  1 and 2 were initially<br \/>\nappointed  as  Rig-man\tin  the months of  March,  1967\t and<br \/>\nNovember,  1967\t respectively.\tRespondent Nos.\t 3,4  and  5<br \/>\nwere  initially\t appointed  as Boring Mistry,  Grade  II  in<br \/>\nFebruary,  1984, July, 1984 and January, 1984  respectively.<br \/>\nRespondent  Nos.   1  and 2 were promoted in  the  month  of<br \/>\nFebruary,  1983 from the post of Rig-man which was later  on<br \/>\nre-designated\tas   Boring-Mistry,  Grade   I\t and   again<br \/>\nre-designated  as Drill Operator, Grade I in the year  1990.<br \/>\nRespondent Nos.\t 3,4 and 5 were working on the post of Drill<br \/>\nOperator,  Grade  II.\tOn  November  22,  1990\t Rules\twere<br \/>\npromulgated  under Section 124 of the Constitution of  Jammu<br \/>\nand  Kashmir  styled as Jammu &amp; Kashmir Geology and  Mining<br \/>\n(Subordinate)  Service Recruitment Rules, 1990.\t The  Rules<br \/>\nwere  to come into force from the date of their\t publication<br \/>\nin  the\t Government Gazette, which, it is said, was done  on<br \/>\nNovember  22,  1990.   Under   these  Rules,  the  requisite<br \/>\nqualification  for  promotion  of a Drilling  Assistant\t was<br \/>\nprescribed  as\tmatriculation  with five years\tservice\t as<br \/>\nBoring\tMistry,\t Grade\tI or Drill Operator, Grade  I.\t For<br \/>\npromotion  to  the  post  of Boring  Mistry,  Grade  I\/Drill<br \/>\nOperator,   Grade  I,  the   minimum   basic   qualification<br \/>\nprescribed  was\t matriculation with seven years\t service  as<br \/>\nBoring\tMistry,\t Grade\tII  or\tDrill  Operator,  Grade\t II.<br \/>\nRecruitment to the post of Rig-man, that is, Drill Operator,<br \/>\nGrade  II  and Assistant Drilling (Now\tDrilling  Assistant)<br \/>\nwere  made  partly by appointment from state subjects  whose<br \/>\nacademic  qualification\t was  matriculation  and  above\t and<br \/>\npartly\ton contract basis from non-state subjects possessing<br \/>\nvast  experience in drilling but without necessary  academic<br \/>\nqualification.\t The services of these persons appointed  on<br \/>\ncontract  basis was subsequently regularised by a Government<br \/>\norder  with all benefits of promotion, pension, etc.  It was<br \/>\nnoticed\t that in the higher promotional posts the incumbents<br \/>\nhad   to   shoulder  higher   responsibilities,\t  such\t as,<br \/>\nmaintaining log books, keeping records of inventories and do<br \/>\nother\ttechnical  and\tadministrative\t tasks\t for   which<br \/>\nqualification  of  matriculation was  considered  necessary.<br \/>\nNone  of  the  respondents possessed  the  qualification  of<br \/>\nmatriculation.\t Therefore,  they could not be\tpromoted  to<br \/>\nhigher\tgrades.\t  The  High Court took the  view  that\twhen<br \/>\nrespondent  Nos.  1 and 2 had been promoted last in the year<br \/>\n1983 insistence on matriculation qualification for promotion<br \/>\nto  a  higher post was illogical and for such posts  service<br \/>\nexperience  should be the sole criteria.  On that basis, the<br \/>\nlearned\t Single\t Judge\tallowed\t the  writ  petitions.\t The<br \/>\nDivision Bench, to which the appeal was preferred, also took<br \/>\nthe similar view and it was stated that the respondents were<br \/>\npromoted  in  the year 1983 and therefore, they\t are  facing<br \/>\ncomplete  stagnation  not because of absence of\t promotional<br \/>\navenues\t but  because  of the requirement  of  matriculation<br \/>\nqualification.\tBy the time they reach that stage they would<br \/>\nbe  at\tthe  fag end of their career and insistence  on\t the<br \/>\npassing\t of  the  matriculation\t would be  fatal  as  it  is<br \/>\nimpossible  for them to take such an examination now and  it<br \/>\nwas  observed that the Rules have to be amended suitably  to<br \/>\navoid  stagnation and adverted to the decision of this Court<br \/>\nin  <a href=\"\/doc\/1702514\/\">T.R.Kothandaraman &amp; Ors.  vs.  Tamil Nadu Water Supply &amp;<br \/>\nDrainage Board &amp; Ors.,<\/a> 1994(6) SCC 282.\t The learned counsel<br \/>\nfor  the appellants submitted that the High Court could\t not<br \/>\nhave  directed amendments of the Rules particularly when  it<br \/>\nhad  noticed  that the promotional avenue from one grade  to<br \/>\nanother\t was  available subject to certain conditions,\tsuch<br \/>\nas,  fulfilment of qualifications and experience.  It is not<br \/>\na   case  where\t the  Rules   did  not\tpermit\t promotional<br \/>\nopportunities  at  all to higher grade from lower grade\t and<br \/>\nthe  hardship  resulting to one or two individual  employees<br \/>\nshould\tnot be taken note as a general standard to give\t the<br \/>\nimpugned  directions  and,  therefore, the  learned  counsel<br \/>\nsubmitted  that the view of the High Court is not  justified<br \/>\nat  all.  The learned counsel for the respondents vehemently<br \/>\ncontended  that the promotional opportunity under the  Rules<br \/>\nis  only a mirage by reason of the qualifications prescribed<br \/>\nthereto\t  which\t  are  impossible  of  fulfilment   by\t the<br \/>\nrespondents.   When the respondents joined the service\tlong<br \/>\nbefore\t these\t Rules\twere   promulgated  there   was\t  no<br \/>\nprescription of qualification of matriculation for promotion<br \/>\nand  sole  avenue for promotion is deprived of by reason  of<br \/>\nprescription   of   such   qualification.   He,\t  therefore,<br \/>\nsubmitted  that relaxation in the Rules is required and\t all<br \/>\nthat  the  High Court has directed is to relax the  relevant<br \/>\nrules  which would result in benefit to the respondents and,<br \/>\ntherefore,  no interference is called for.  He also  pointed<br \/>\nout  that  in  case of one J.R.Sharma the benefit  had\tbeen<br \/>\nextended to him in relaxation of the Rules.  The law is well<br \/>\nsettled\t that  it  is  permissible  for\t the  Government  to<br \/>\nprescribe  appropriate\tqualifications\tin   the  matter  of<br \/>\nappointment  or promotion to different posts.  The case\t put<br \/>\nforth  on behalf of the respondents is that when they joined<br \/>\nthe service the requirement of passing the matriculation was<br \/>\nnot  needed and while they are in service such\tprescription<br \/>\nhas  been  made\t to their detriment.  But it is\t clear\tthat<br \/>\nthere  is no indefeasible right in the respondents to  claim<br \/>\nfor promotion to a higher grade to which qualification could<br \/>\nbe  prescribed\tand there is no guarantee that\tthose  rules<br \/>\nframed\tby  the\t Government in that behalf would  always  be<br \/>\nfavourable  to\tthem.\t<a href=\"\/doc\/1888316\/\">In Roshan Lal Tandon vs.   Union  of<br \/>\nIndia,<\/a>\t1968(1) SCR 185, it was held by this Court that once<br \/>\nappointed  an employee has no vested right in regard to\t the<br \/>\nterms  of service but acquires a status and, therefore,\t the<br \/>\nrights\tand obligations thereto are no longer determined  by<br \/>\nconsent\t of parties, but by statute or statutory rules which<br \/>\nmay  be\t framed and altered unilaterally by the\t Government.<br \/>\nThe  High  Court has also noticed that there was  an  avenue<br \/>\nprovided   for\tpromotion  but\t the  prescription  of\t the<br \/>\nqualification  was  not\t favourable   to  respondents.\t The<br \/>\nprinciple  of avoiding stagnation in a particular post\twill<br \/>\nnot  be\t with reference to a particular individual  employee<br \/>\nbut with reference to the conditions of service as such.  As<br \/>\nlong  as  rules provide for conditions of service making  an<br \/>\navenue\tfor promotion to higher grades the observations made<br \/>\nin  T.R.Kothandaramans\tcase [supra] stand  fulfilled.\t In<br \/>\nthat  view of the matter, we do not think the High Court was<br \/>\njustified  in  allowing\t the  writ petitions  filed  by\t the<br \/>\nrespondents.   The case of J.R.Sharma stood altogether on  a<br \/>\ndifferent  footing who was appointed in the year 1962 and he<br \/>\nwas  promoted  to higher grades with effect from 1989,\tthat<br \/>\nis,  prior  to the coming into force of the Rules.  In\tthat<br \/>\nview  of the matter, we do not think that that case could be<br \/>\ntaken  note  of\t in giving any directions in favour  of\t the<br \/>\nrespondents.   In  the result, we allow this appeal and\t set<br \/>\naside  the order made by the High Court affirming the  order<br \/>\nmade  by  the  learned\tSingle Judge and  dismiss  the\twrit<br \/>\npetitions filed by the respondents.
