and X-Obj No. 32-CI of 1998,1915 and X-Obj No.34-CI of 1998,1916 and<\/p>\n
X-Obj No.41-CI of 1998,1917 and X-Obj No.36-CI of 1998,1918,1919 and<\/p>\n
X-Obj No.38-CI of 1998,1920,1921,1922 and X-Obj No.37-CI of<\/p>\n
1998,1923,1924,1925,1926 and X-Obj No.39-CI of 1998,1927 and X-Obj<\/p>\n
No.33-CI of 1998,1928 and X-Obj No.44-CI of 1998,1929,1930 and X- Obj<\/p>\n
No.35-CI of 1998 and 1931 all of 1991 as the common questions of law and<\/p>\n
facts are involved in all these appeals.\n<\/p>\n
 RFA No.1909 of 1991                  2<\/span><\/p>\n
            Land situated in the revenue estate of village Dadhi,Tehsil and<\/p>\n
District Ropar, measuring 24.82 acre was notified under Section 4 of the<\/p>\n
Land Acquisition Act,1894 (for short,’the Act’),dated 13.12.1984 followed<\/p>\n
by declaration under Section 6 of the Act issued on 24.12.1984, for public<\/p>\n
purpose namely, for the construction of SYL. Canal. The Land Acquisition<\/p>\n
Collector awarded compensation @ Rs. 27972\/- per acre for the acquired<\/p>\n
land which was gair-mumkin. Aggrieved with the inadequacy of<\/p>\n
compensation, the claimants\/landowners filed objections under Section 18<\/p>\n
of the Act, which were referred to the Civil Court where the claimants had<\/p>\n
prayed for higher compensation. On the other hand, the appellants herein<\/p>\n
defended the validity of the award of the Collector and alleged that<\/p>\n
compensation awarded is adequate, fair and reasonable and does not call for<\/p>\n
further enhancement.\n<\/p>\n
            The claimants examined PW-1 Pritam Singh, who tendered sale<\/p>\n
deeds Ex.P-1 to P-4 and a copy of the agreement mark A. On the other hand,<\/p>\n
the respondents\/appellants herein examined Joginder Singh, Kanungo as<\/p>\n
RW-1 and tendered sale deeds Exs. R-1,R-2 and Akash-Sajra Ex. R-3.<\/p>\n
            After appreciating the evidence brought on file, the learned<\/p>\n
District Judge, Ropar, vide his award dated 1.4.1991 reassessed the market<\/p>\n
value of the acquired land @ Rs. 50,000\/- per acre.\n<\/p>\n
            The State of Punjab has preferred the aforesaid appeals against<\/p>\n
the award of the learned District Judge, Ropar dated 1.4.1991.<\/p>\n
            Mr.N.S.Pawar, learned Addl. A.G. Punjab, appearing for the<\/p>\n
appellant-State has contended that the Court below has committed palpable<\/p>\n
error in enhancing the compensation at a higher rate of Rs.50,000\/- per acre
\n RFA No.1909 of 1991                                3<\/span><\/p>\n
as compared to the prevailing market rate.\n<\/p>\n
                 No     body      has     put     in    appearance         on    behalf      of     the\n\nrespondents\/claimants.\n\n<\/pre>\n
                 I have heard learned counsel for the appellants-State and have<\/p>\n
perused the record with his assistance.\n<\/p>\n
                 The claimants examined PW-1 Pritam Singh, who deposed that<\/p>\n
he is Lamberdar of village Dadhi. Village Hardo Nimoh is at a distance of<\/p>\n
4\/5 kilometers from his village. There is only Nangal Hydel canal in<\/p>\n
between his village and Ropar-Nangal Highway. He deposed that Kiratpur<\/p>\n
town is at a distance of about one kilometer from his village Dadhi. He<\/p>\n
further deposed that he is the witness to sale deeds Ex. P-1 to P-4. Village<\/p>\n
Dadhi falls in District Ropar and village Hardo Nimoh is also in District<\/p>\n
Ropar. The land situated in village Hardo Nimoh was also acquired for<\/p>\n
construction of SYL canal. He stated that villages Anantpur, Kotli, Pathreri,<\/p>\n
kajauli ,Ballan etc. fall in Ropar District and the department had awarded<\/p>\n
the compensation for the land acquired in these villages @ not less than<\/p>\n
Rs.1,00,000\/- per acre. He also deposed that there was an agreement with<\/p>\n
the Chief Minister,Punjab and the claimants. Besides the oral evidence, the<\/p>\n
claimants have tendered sale deeds Exs. P-1 to P-4 which are tabulated<\/p>\n

                 The learned Civil Court had observed that the aforesaid sale
\n RFA No.1909 of 1991                    4<\/span><\/p>\n
deeds cannot be taken into consideration because the sale has taken place<\/p>\n
after issuance of notification under Section 4 and declaration under Section<\/p>\n
6 of the Act. However, acquisition is of 13.12.1984, whereas Ex P-1 is the<\/p>\n
sale deed dated 11.9.1985 of village Dadhi, by which the land has been sold<\/p>\n
for Rs.80,000\/- per acre which shows upward trend. Even Exs.P-2 to P-4<\/p>\n
which are sale deeds of village Hardo Nimoh, adjacent to village Dadhi,<\/p>\n
wherein also rising trend is shown because the land has been sold towards<\/p>\n
the close of the year 1985 and beginning of the year 1986 for over more<\/p>\n
than Rs. 4,00,000\/- per acre.    Therefore, in these circumstances, the Court<\/p>\n
had found that since the land in question of village Dadhi is on the Ropar<\/p>\n
Nangal road and is near Kiratpur town. Therefore, the amount of Rs.50000\/-<\/p>\n
per acre has been awarded over and above the compensation of Rs. 27972\/-<\/p>\n
per acre assessed by the Collector, which in my view, is just and adequate in<\/p>\n
the facts and circumstances of the present case.\n<\/p>\n
              So far as the sale instances Exs. R-1 and R-2 are concerned, the<\/p>\n
same cannot be taken into consideration simply for the reason that average<\/p>\n
price per acre in respect of sale instance Ex.R-1 comes to Rs. 6400\/- per<\/p>\n
acre and the average price in respect of sale instance Ex.R-2 comes to<\/p>\n
Rs.3600\/- per acre, which is much less than the award of the Collector<\/p>\n
assessed @ Rs.27972\/- per acre.\n<\/p>\n
              No one chose to appear for land-owners to argue the cross<\/p>\n
objections.\n<\/p>\n
              In view of the totality of facts and circumstances, I do not find<\/p>\n
any substances in the arguments raised by learned counsel for the<\/p>\n
appellants-State that the compensation of Rs.50,000\/- per acre is on higher
\n RFA No.1909 of 1991                 5<\/span><\/p>\n
side. Therefore, the present appeals being meritless as well as the cross<\/p>\n
objections which are devoid of any merit, are hereby dismissed without any<\/p>\n
order as to costs.\n<\/p>\n<\/p>\n
