Heard learned counsel for the petitioner and learned<br \/>\nStanding counsel and perused the records.\n<\/p>\n<p>2. Present petition has been preferred under Article 226 of the<br \/>\nConstitution of India against the impugned order of transfer<br \/>\npassed by the Inspector General of Police concerned<br \/>\ntransferring the petitioner from one place to another place. The<br \/>\nsubmission of the learned counsel for the petitioner is that the<br \/>\norder of transfer could not have been passed by the D.I.G.<br \/>\nkeeping in view the mandate of Prakash Singh&#8217;s case reported<br \/>\nin 2006 (8) SCC 1, Prakash Singh Vs. Union of India.<br \/>\nAccording to case of Prakash Singh (supra) transfer could have<br \/>\nbeen done only by the Police Establishment Board constituted<br \/>\nby the State Government. Admittedly, the impugned order has<br \/>\nnot been passed by the Police Establishment Board.\n<\/p>\n<p>3. Though learned Standing counsel tried to defend his cause<br \/>\nstating that the order of transfer has been passed within the<br \/>\nrange by the Deputy Inspector General of Police under Para<br \/>\n520 of the U.P. Police Regulation, but a plain reading of the<br \/>\njudgement of Prakash Singh Vs. (supra) shows that their<br \/>\nLordship of Hon&#8217;ble Supreme Court had not differentiated the<br \/>\ntransfer of police officer either within the range or outside the<br \/>\nrange.\n<\/p>\n<p>4. A faint argument has been advanced by the learned Standing<br \/>\ncounsel that the case of Prakash Singh (supra) shall not effect<br \/>\nthe statutory provisions like U.P. Police Regulation and<br \/>\nauthorities have got power to transfer the police officer from one<br \/>\nplace to other place.\n<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>5. Arguments advanced by the learned Standing counsel<br \/>\nseems to be not correct. The case of Prakash Singh (supra)<br \/>\nhas not been decided by Hon&#8217;ble Supreme Court by reviewing<br \/>\nan administrative order. Hon&#8217;ble Supreme Court had issued<br \/>\ndirection in the case of Prakash Singh (supra) in pursuance to<br \/>\npower conferred by Article 142 of the Constitution of India in<br \/>\npublic interest. The Police Regulation contains the compilation<br \/>\nof Government order issued in pursuance to power conferred<br \/>\nby the Police Act. Accordingly, in case the provision contained<br \/>\nin the Police Regulation is contrary to judgement of Hon&#8217;ble<br \/>\nSupreme Court then State Government have to amend the<br \/>\nPolice Regulation in appropriate manner in conformity with the<br \/>\njudgement of Prakash Singh (supra).\n<\/p>\n<p>6. Their Lordships of Hon&#8217;ble Supreme Court in catena of<br \/>\njudgements while interpreting the provision contained in Article<br \/>\n142 of the Constitution of India held that State or its<br \/>\ninstrumentalities have got no right to avoid the direction issued<br \/>\nby the Hon&#8217;ble Supreme Court. Hon&#8217;ble Supreme Court further<br \/>\nheld that where executive failed to fill up the gap in legislation<br \/>\nthe judiciary have to step in. Direction issued by the Hon&#8217;ble<br \/>\nSupreme Court under Article 142 of the Constitution of India is<br \/>\nmend to do justice and it enlarges the power of Hon&#8217;ble<br \/>\nSupreme Court for making an order to do complete justice<br \/>\nbetween parties or in public interest vide (1984) 3 SCC 549,<br \/>\n<a href=\"\/doc\/1325483\/\">Azhar Ali Khan V. Commr. Municipal Corpn. Of Delhi<\/a>; (1998)<br \/>\n1 SCC 226, <a href=\"\/doc\/1203995\/\">Vineet Narain v. Union of India<\/a>; (2006) 2 SCC<br \/>\n677, Ramesh Kumari v. State (NCT of Delhi); (1993) 2 SCC<br \/>\n703, <a href=\"\/doc\/571597\/\">Kashinath G. Jalmi (Dr) v. The Speaker<\/a>; (2006) 1 SCC<br \/>\n737, Raj Kumar V. Union of India; (1991) 4 SCC 584, <a href=\"\/doc\/1613412\/\">Union<br \/>\nCarbide Corpn. v. Union of India<\/a>; (2005) 3 SCC 284, <a href=\"\/doc\/1521407\/\">Kalyan<br \/>\nChandra Sarkar v. Rajesh Ranjan<\/a>; (2003) 6 SCC 581; (1993)<br \/>\n4 SCC 119, <a href=\"\/doc\/1707104\/\">R.K.Jain v. Union of India.<\/a>\n<\/p>\n<p>7. Apart from above every judgement and order passed or<br \/>\nissued by Hon&#8217;ble Supreme Court is binding on the State as<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>well as subordinate court, authorities and Tribunal in view of<br \/>\nArticle 141 of the Constitution of India. State or its<br \/>\ninstrumentalities lacks jurisdiction to defy the judgement of<br \/>\nHon&#8217;ble Supreme Court by interpreting the same in the way<br \/>\nwhich suits to them. For any ambiguity it is always open to the<br \/>\nState Government to approach Hon&#8217;ble Supreme Court for<br \/>\nclarification. So far as government or its instrumentalities,<br \/>\nsubordinate courts, High Court and Tribunal are concerned they<br \/>\nhave to abide by the direction issued by the Hon&#8217;ble Supreme<br \/>\nCourt. Non compliance of judgement of Hon&#8217;ble Supreme Court<br \/>\nshall amount to committing contempt of Hon&#8217;ble Supreme<br \/>\nCourt.\n<\/p>\n<p>8. Accordingly, since U.P. Police Regulation contained the<br \/>\nGovernment order issued in pursuance to power conferred by<br \/>\nSection 2 of the Police Act it shall be appropriate for the State<br \/>\ngovernment to make appropriate amendment in the U.P. Police<br \/>\nRegulation to mould it in conformity with the judgement of<br \/>\nHon&#8217;ble Supreme Court in the case of Prakash Singh (supra).\n<\/p>\n<p>9. In the Case of Prakash Singh (supra) with regard to<br \/>\nconstitution of Police Establishment Board their Lordship of<br \/>\nApex Court had issued the following direction; to reproduce:-\n<\/p>\n<p>&#8220;Police            Establishment              Board<br \/>\n(5) There shall be a Police Establishment Board in each<br \/>\nState which shall decide all transfers, postings,promotions and<br \/>\nother       service       related        matters       of<br \/>\nofficers of and below the rank of Deputy Superintendent of<br \/>\nPolice. The Establishment Board shall be a departmental body<br \/>\ncomprising the Director General of Police and four other senior<br \/>\nofficers of the Department. The State Government may<br \/>\ninterfere with decision of the Board in exceptional cases only<br \/>\nafter recording its reasons for doing so. The Board shall also be<br \/>\nauthorized to make appropriate recommendations to the State<br \/>\nGovernment regarding the posting and transfers of officers of<br \/>\nand above the rank of Superintendent of Police, and the<br \/>\n<span class=\"hidden_text\">                                    4<\/span><\/p>\n<p>Government is expected to give due weight to these<br \/>\nrecommendations and shall normally accept it. It shall also<br \/>\nfunction as a forum of appeal for disposing of representations<br \/>\nfrom         officers      of           the        rank              of<br \/>\nSuperintendent      of   Police    and        above    regarding           their<br \/>\npromotion\/transfer\/disciplinary        proceedings     or        their    being<br \/>\nsubjected to illegal or irregular orders and generally reviewing<br \/>\nthe       functioning    of       the         police        in       the<br \/>\nState.&#8221;\n<\/p>\n<p>10. A plain reading of mandate of Hon&#8217;ble Supreme Court with<br \/>\nregard to Police Establishment Board shows that the Board<br \/>\nshall decide the transfers, posting, promotions and other<br \/>\nservice related matters of officers of and below the rank of<br \/>\nDeputy Superintendent of Police. The Board shall comprise the<br \/>\nDirector General of Police and four other senior officer of the<br \/>\ndepartment. The decision of the Board may be interfered by the<br \/>\nState Government only in exceptional cases after recording<br \/>\nreasons.\n<\/p>\n<p>11. In view of above, it is apparent that a decision should be<br \/>\ntaken by the Board with regard to transfer, posting, promotions<br \/>\nand service related matters. It is not a body to approve the<br \/>\ndecision taken by the state Government.\n<\/p>\n<p>12. A part from constitution of Police Establishment Board<br \/>\nHon&#8217;ble Supreme Court had also directed to constitute the<br \/>\nPolice Complaints authority. Relevant portion is reproduced as<br \/>\nunder:-\n<\/p>\n<p>&#8220;Police Complaints Authority:\n<\/p>\n<p>(6) There shall be a Police Complaints Authority at the<br \/>\ndistrict level to look into complaints against police officers of<br \/>\nand up to the rank of Deputy Superintendent of Police.<br \/>\nSimilarly, there should be another Police Complaints Authority<br \/>\nat the State level to look into complaints against officers of the<br \/>\n<span class=\"hidden_text\">                                5<\/span><\/p>\n<p>rank of Superintendent of Police and above. The district level<br \/>\nAuthority may be headed by a retired District Judge while the<br \/>\nState level Authority may be headed by a retired Judge of the<br \/>\nHigh Court\/Supreme Court. The head of the State level<br \/>\nComplaints Authority shall be chosen by the State Government<br \/>\nout of a panel of names proposed by the Chief Justice; the<br \/>\nhead of the district level Complaints Authority may also be<br \/>\nchosen out of a panel of names proposed by the Chief Justice<br \/>\nor a Judge of the High Court nominated by him.\n<\/p>\n<p>These Authorities may be assisted by three to five members<br \/>\ndepending upon the volume of complaints in different<br \/>\nStates\/districts, and they shall be selected by the State<br \/>\nGovernment from a panel prepared by the State Human Rights<br \/>\nCommission\/Lok Ayukta\/State Public Service Commission. The<br \/>\npanel may include members from amongst retired civil<br \/>\nservants, police officers or officers from any other department,<br \/>\nor from the civil society. They would work whole time for the<br \/>\nAuthority and would have to be suitably remunerated for the<br \/>\nservices rendered by them. The Authority may also need the<br \/>\nservices of regular staff to conduct field inquiries. For this<br \/>\npurpose, they may utilize the services of retired investigators<br \/>\nfrom the CID, Intelligence, Vigilance or any other organization.<br \/>\nThe State level Complaints Authority would take cognizance of<br \/>\nonly allegations of serious misconduct by the police personnel,<br \/>\nwhich would include incidents involving death, grievous hurt or<br \/>\nrape in police custody. The district level Complaints Authority<br \/>\nwould, apart from above cases, may also inquire into<br \/>\nallegations of extortion, land\/house grabbing or any incident<br \/>\ninvolving serious abuse of authority. The recommendations of<br \/>\nthe Complaints Authority, both at the district and State levels,<br \/>\nfor any action, departmental or criminal, against a delinquent<br \/>\npolice officer shall be binding on the concerned authority.&#8221;\n<\/p>\n<p>13. Hon&#8217;ble Supreme Court had directed to constitute Police<br \/>\n<span class=\"hidden_text\">                                  6<\/span><\/p>\n<p>Establishment Board and Police Complaints Authority so that<br \/>\npolice personnel may not work under the political pressure or<br \/>\ninterference and may deal with the crime independently,<br \/>\nhonestly and fairly.\n<\/p>\n<p>14. In the present case, at the face of record the impugned<br \/>\norder has been passed by the Inspector General of Police<br \/>\nconcerned and not by the Board. Accordingly, the impugned<br \/>\ntransfer order has been passed in utter disregard to judgement<br \/>\nof Prakash Singh (supra) which is not sustainable.\n<\/p>\n<p>15. In view of above, writ petition deserves to be allowed. A writ<br \/>\nin the nature of certiorari is issued quashing the impugned<br \/>\norder dated 19.5.2010 as contained in Annexure-1 to the writ<br \/>\npetition to the extent it relates to petitioner with consequential<br \/>\nbenefits with liberty to pass afresh order.\n<\/p>\n<p>16. In a Writ Petition No. 1525 of 2009 (SS) decided vide order<br \/>\ndated 4.9.2009 a direction was issued to constitute Police<br \/>\nEstablishment Board in pursuance to judgement of Prakash<br \/>\nSingh (supra) but it appears that the same has not been<br \/>\ncomplied with. It is expected that State government shall<br \/>\nproceed in terms of earlier judgement forthwith to avoid any<br \/>\naction by this Court on account of non-compliance of direction<br \/>\nissued earlier.\n<\/p>\n<p>17. It shall be open to the Police Establishment Board to<br \/>\nreconsider the petitioner&#8217;s case and pass a fresh order.\n<\/p>\n<p>18.
