Justice ANTONY DOMINIC\n\n Dated :27\/09\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n\n             ```````````````````````````````````````````````````````\n                 W.P.(C) No. 26830 of 2010 C\n             ```````````````````````````````````````````````````````\n            Dated this the 27th day of September, 2010\n\n                            J U D G M E N T\n<\/pre>\n<p>           Challenge in the writ petition is against Ext.P4,<\/p>\n<p>whereby petitioner was informed that in view of the<\/p>\n<p>disqualification under Section 35 of the Kerala Panchayat Raj<\/p>\n<p>Act, 1994, suffered by the petitioner, he was disqualified from<\/p>\n<p>contesting election to the local bodies.\n<\/p>\n<p>      2.   It is now informed that in the judgment dated 14-<\/p>\n<p>09-2010 in W.P.(C) No.26965\/2010, a Division Bench of this<\/p>\n<p>Court has clarified that the disqualification under Section 35 of<\/p>\n<p>the Act is for the term of the Panchayat and that a person like<\/p>\n<p>the petitioner is eligible to contest in the subsequent elections.<\/p>\n<p>      In that view of the matter, quashing Ext.P4 and clarifying<\/p>\n<p>that the petitioner will be eligible to contest in the forthcoming<\/p>\n<p>election to the Panchayat, this writ petition is disposed of.<\/p>\n<p>                                            (ANTONY DOMINIC, JUDGE)<br \/>\naks<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court O.D.Thomas vs Thomas on 27 September, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 26830 of 2010(C) 1.
