In pursuance of the said impugned<br \/>\norder, the petitioner is detained in jail.\n<\/p>\n<p>\t\tHeard<br \/>\nthe learned advocate for the petitioner and the learned AGP for the<br \/>\nrespondents.\n<\/p>\n<p>No affidavit-in-reply is filed by the learned AGP on behalf of the<br \/>\nrespondents controverting the averments made in the petition.  The<br \/>\naffidavit-in-reply filed by the learned AGP on behalf of the<br \/>\nrespondents is taken on record and considered.\n<\/p>\n<p>\t\tFrom<br \/>\nthe grounds of detention, it appears that three offences  being<br \/>\nCR.I.No.5041 of 2007, 4074 of 2009 and 5153 of 2009  under sections<br \/>\n66 (1)b and 65(e)  etc.  under the Bombay Prohibition Act,  were<br \/>\nregistered with  Gomtipur police station, wherein quantity of 114<br \/>\nbottles, 11 bottles and 1 bottle of foreign liquor were  found from<br \/>\nthe possession of the detenu.    On the basis of registration of<br \/>\nthese cases, the detaining authority held that the present detenu was<br \/>\ncarrying on activities of selling country liquor which is harmful to<br \/>\nthe health of the public.  It is held by the detaining authority that<br \/>\nas the detenu is indulged in illegal activities, it is required to<br \/>\nrestrain her from carrying out further illegal activities i.e.<br \/>\nselling of liquor. The detaining authority has placed reliance  on<br \/>\nthe above registered offences and statements of  unnamed witnesses.<br \/>\nIn the opinion of this court, the activities of the detenu  can, by<br \/>\nno stretch of reasoning, be said to be disturbing the public order.<br \/>\nIt is seen from the grounds that a general statement that has been<br \/>\nmade by the detaining authority that consuming liquor is injurious to<br \/>\nhealth.   In fact, a perusal of the order passed by the detaining<br \/>\nauthority shows that the grounds which are mentioned in the order are<br \/>\nin reference to the situation of &#8216;law and order&#8217; and not &#8216;public<br \/>\norder&#8217;.  Therefore, on this ground, the subjective satisfaction of<br \/>\nthe detaining authority is vitiated on account of non-application of<br \/>\nmind and the impugned order, therefore, deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>3.\t\tExcept<br \/>\ntwo statements of the anonymous witnesses,  there is no material on<br \/>\nrecord which shows that the petitioner-detenu is carrying out illegal<br \/>\nactivities of selling  liquor which is harmful to the health of the<br \/>\npublic.  In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki  v.<br \/>\nPolice Commissioner, Surat<\/a> (2001 (1) GLH 393), having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\nManohar Lohia  v. State of Bihar (AIR 1966 SC 740), this<br \/>\ncourt held that the cases wherein the detention order are passed on<br \/>\nthe basis of the statements of such witnesses fall under the<br \/>\nmaintenance of   law and order  and not  public order .\n<\/p>\n<p>4.\t\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing  an<br \/>\norder of detention of a detenu, the detaining authority must come to<br \/>\na definite finding that there is threat to the &#8216;public order&#8217; and it<br \/>\nis very clear that  the present case  would not fall within the<br \/>\ncategory of threat to a public order.  In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.\t\tIn<br \/>\nthe result,  this<br \/>\nSpecial Civil Application is allowed.  The impugned order of<br \/>\ndetention dated 03.9.2009  passed by the Police Commissioner,<br \/>\nAhmedabad City is quashed and set aside.  The detenu is  ordered to<br \/>\nbe set at liberty forthwith if not required in any  other case.  Rule<br \/>\nis made absolute.
