1.\tThis
\nis an application preferred under Section 439 of the Code of Criminal
\nProcedure, 1973 by the applicants for regular bail, who came to be
\narrested, in connection with F.I.R. registered as  C.R. No. I-289 of
\n2009 with Visnagar Police Station for the offence punishable under
\nSections 376 and 114 of the Indian Penal Code.\n<\/p>\n
2.\tLearned
\nadvocate for the applicants submitted that the applicants are not the
\nmain culprit who were involved in the alleged commission of offence
\npunishable under Sections 376 and 114 of the Indian Penal Code.
\nConsidering the role attributed to the applicants which can be seen
\nfrom the F.I.R. at Annexure-A to the application and at the most they
\ncan be said to be abettor in the alleged commission of offence. In
\nview of the aforesaid aspects, learned advocate submitted that all
\nthe applicants deserve to be enlarged on bail.\n<\/p>\n
3.\tLearned
\ncounsel for the complainant has submitted that the applicants have
\ncommitted a serious offence punishable under Sections  376 and 114 of
\nthe Indian Penal Code and the manner in which the offence is
\ncommitted by the applicants along with the main culprit, no
\ndiscretionary relief be granted and the application deserves to be
\ndismissed.\n<\/p>\n
4.\tLearned
\nA.P.P. Ms. Manisha L. Shah, representing the State, while opposing
\nthe bail application, submitted that considering the role played by
\nthe applicants which is reflected in F.I.R. at Annexure-A to the
\napplication and the manner in which the offence is committed by the
\napplicants along with the main culprit, no lenient view be taken in
\nthe matter and the application does not call for any interference by
\nthis Court and the same is deserves to be dismissed.\n<\/p>\n
5.\tI
\nhave heard learned advocate Mr. D.K. Puj appearing for the
\napplicants, learned advocate Mr. Y.M. Thakore for the complainant and
\nlearned A.P.P. Ms. Manisha  L. Shah appearing for the State at length
\nand in great detail. I have considered the averments made in the
\napplication,  role attributed to the applicants which is reflected in
\nF.I.R. at Annexure-A to the application, provisions of Sections 376
\nand 114 of the Indian Penal Code, police papers, quantum of
\npunishment etc. Considering the same, I am of the view that the
\napplicants are at the most can be said to have been abettor in the
\ncommission of offence punishable under Section 376 and 114 of the
\nIndian Penal Code. In view of the above, I am of the view that the
\napplicants deserve to be enlarged on bail.\n<\/p>\n
6.\tIn
\nthe facts and circumstances of the case, the application is allowed
\nand the applicants are ordered to be enlarged on bail in connection
\nwith C.R. No. I-289  of 2009 registered at Visnagar Police Station on
\nexecuting a bond of Rs. 10,000\/- (Rupees ten thousand only) each with
\none surety each of the like amount to the satisfaction of the Trial
\nCourt and subject to the conditions that they shall:\n<\/p>\n
(a)\tnot
\ntake undue advantage of their liberty or abuse \ttheir\tliberty;\n<\/p>\n
(b)\tnot
\nact in a manner injurious to the interest of the \tprosecution;\n<\/p>\n
(c)\tsurrender
\ntheir passport, if any, to the lower court \twithin a \tweek.\n<\/p>\n
(d)\tnot
\nleave the State of Gujarat without the prior \tpermission of the
\nSessions Court concerned;\n<\/p>\n
(e)\tmark
\ntheir presence at the concerned Police Station on \tany \tday of every
\nfirst week of English calendar month \tbetween \t9.00 AM and 2.00 PM.
\ntill the trial is over;\n<\/p>\n
(f)\tfurnish
\nthe present address of their residence to the I.O. \tand \talso to the
\nCourt at the time of execution of the \tbond and \tshall not change
\ntheir residence without prior \tpermission of this Court;\n<\/p>\n
(g)\tmaintain
\nlaw and order.\n<\/p>\n
7.\tIf
\nbreach of any of the above conditions is committed, the Sessions
\nJudge concerned will be free to issue warrant or to take appropriate
\naction in the matter.\n<\/p>\n
8.\tBail
\nbond to be executed before the lower Court having jurisdiction to try
\nthe case.\n<\/p>\n
9.\tAt
\nthe trial, the Trial Court shall not be influenced by the
\nobservations of preliminary nature, qua the evidence at this stage,
\nmade by this Court while enlarging the applicants on bail.\n<\/p>\n
10.\tRule
\nis made absolute to the aforesaid extent.\n<\/p>\n
\tDirect
\nService is permitted.\n<\/p>\n
