TATA TELE SERVICES LIMITED, THROUGH THE NODAL\n          OFFICER    MAHARAJA KAMESHWAR COMPLEX, 2ND FLOOR,\n          FRAZER ROAD, PATNA\n                               -----------\n<\/pre>\n<p>02.   03.03.2011             Heard learned counsel for the petitioner and<\/p>\n<p>                   learned counsel for the State.\n<\/p>\n<p>                             The petitioner alleges illegal encroachment of<\/p>\n<p>                   Government lands by construction of a Mobile tower by<\/p>\n<p>                   a private service provider, M\/s Tata Tele Services<\/p>\n<p>                   Limited on lands identified as plot no. 2656 (old) 75<\/p>\n<p>                   (new) 67 (gh) (part of plot no. 2656\/75) at Mohalla-<\/p>\n<p>                   Rikabganj, Nagar Panchayat- Tekari.<\/p>\n<p>                             It is submitted that the lands belonged to<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>       the Government and were being utilized by villagers for<\/p>\n<p>       draining water which used to accumulate it in the<\/p>\n<p>       ditch.\n<\/p>\n<p>                  Learned counsel for the State very fairly<\/p>\n<p>       acknowledges     that   this    cannot    be   described   as<\/p>\n<p>       drainage in a civil society which requires a proper<\/p>\n<p>       system of drainage. He further acknowledges that no<\/p>\n<p>       third party construction can come up on Government<\/p>\n<p>       lands without proper authorization in accordance with<\/p>\n<p>       law.\n<\/p>\n<p>                  Let the District Magistrate, Gaya examine<\/p>\n<p>       the contentions of the petitioner and take appropriate<\/p>\n<p>       remedial action as may be needed on both counts so<\/p>\n<p>       that citizens did not suffer.\n<\/p>\n<p>                  Let appropriate action as found applicable in<\/p>\n<p>       the law be done within a maximum period of six weeks<\/p>\n<p>       from the date of receipt\/production of a copy of this<\/p>\n<p>       order.\n<\/p>\n<p>                  The application stands disposed.<\/p>\n<pre>P.K.
