Therefore, a bill of theft dated 23.10.2000 for<br \/>\nRs.8,21,176\/- was served upon the respondent. However, the respondent<br \/>\ndid not make payment of the said amount. Therefore, the appellant<br \/>\nfiled the suit in question before the Court below for recovery of the<br \/>\namount along with interest and delay charges. However, the said suit<br \/>\ncame to be dismissed by way of the impugned order. Hence, this<br \/>\nappeal.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the appellant and perused the documents on<br \/>\nrecord. Before the Court below, the appellant-company was not able to<br \/>\nestablish its case against the respondent by producing cogent<br \/>\ndocumentary evidence. In fact, the appellant was not able to show by<br \/>\nproducing cogent evidence that the respondent herein had committed<br \/>\ntheft of electricity. It appears that the Notice (Ex.19) allegedly<br \/>\nissued to the respondent is silent as to the nature, manner and<br \/>\nmethod of committing theft by the respondent. In fact, it appears<br \/>\nthat the said Notice was never served upon the respondent. The F.I.R.<br \/>\nfiled in connection with the alleged theft also does not show the<br \/>\nrespondent as an accused. Apart from that no documentary evidence was<br \/>\nproduced to show that there existed a contract between the original<br \/>\nplaintiff and the defendant.\n<\/p>\n<p>4.\tLooking<br \/>\nto the facts of the case and the evidence on record, I am of the<br \/>\nopinion that the Court below was completely justified in rejecting<br \/>\nthe suit of the appellant. I am in complete agreement with the<br \/>\nreasonings given by and the findings arrived at by the Court below<br \/>\nand hence, find no reasons to interfere with the same.\n<\/p>\n<p>5.\tFor<br \/>\nthe foregoing reasons, the appeal is summarily dismissed. No costs.<br \/>\nConsequently, the civil application also stands rejected.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
