BASANT, J.\n            -------------------------------------------------\n                     B.A. No.6859 OF 2007\n            -------------------------------------------------\n        Dated this the 22nd day of November, 2007\n\n                               ORDER\n<\/pre>\n<p>     Application for anticipatory bail.          The petitioner faces<\/p>\n<p>allegations under the Kerala Forest Act. On receipt of discreet<\/p>\n<p>information, the officials of the Forest Department conducted<\/p>\n<p>the search of a residential premises occupied by the widowed<\/p>\n<p>sister of the petitioner herein.         140 Kgs. of sandal wood<\/p>\n<p>freshly\/recently collected from the forest were found concealed<\/p>\n<p>in the premises in gunny bags. The investigation suggested to<\/p>\n<p>the officials that the sandal pieces were kept in the premises<\/p>\n<p>by the petitioner and his son.       Accordingly, a crime has been<\/p>\n<p>registered.    The petitioner and his son have been shown as<\/p>\n<p>accused 1 and 2.      Investigation is in progress. The officials<\/p>\n<p>have not been able to arrest the petitioner or his son so far.<\/p>\n<p>The petitioner apprehends imminent arrest.<\/p>\n<p><span class=\"hidden_text\"> B.A. No.6859 OF 2007           -: 2 :-<\/span><\/p>\n<p>      2. The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent.      He is old, sick and infirm.<\/p>\n<p>Recovery was not effected from his house.           There is also a<\/p>\n<p>submission at the Bar that the petitioner is mentally ill. In these<\/p>\n<p>circumstances, directions under Sec.438 of the Cr.P.C. may be<\/p>\n<p>issued in favour of the petitioner, prays the learned counsel for<\/p>\n<p>the petitioner.\n<\/p>\n<p>      3. The learned Public Prosecutor opposes the application.<\/p>\n<p>The Case Diary has been placed before me for my perusal.           I<\/p>\n<p>have perused the same. The indications reveal that though the<\/p>\n<p>house belongs to the widowed sister of the petitioner, the<\/p>\n<p>petitioner and his son used to frequently visit the said house.<\/p>\n<p>At the moment and with the available inputs, I find no<\/p>\n<p>circumstances which can justify or warrant the invocation of the<\/p>\n<p>extraordinary equitable discretion under Sec.438 of the Cr.P.C.<\/p>\n<p>This, I agree with the learned Public Prosecutor, is a fit case<\/p>\n<p>where the petitioner must appear before the Investigating<\/p>\n<p>Officer or the learned Magistrate having jurisdiction and then<\/p>\n<p>seek regular bail in the ordinary course.\n<\/p>\n<p>      4. In the result, this bail application is dismissed; but with<\/p>\n<p>the observation that if the petitioner surrenders before the<\/p>\n<p>Investigating Officer or the learned Magistrate and seeks bail,<\/p>\n<p><span class=\"hidden_text\">B.A. No.6859 OF 2007            -: 3 :-<\/span><\/p>\n<p>after giving sufficient prior notice to the Prosecutor in charge of<\/p>\n<p>the case, the learned Magistrate must proceed to pass<\/p>\n<p>appropriate orders on merits and expeditiously.<\/p>\n<p>                                                        Sd\/-\n<\/p>\n<p>\n                                              (R.
