Justice V.GIRI\n\n Dated :01\/06\/2009\n\n O R D E R\n                       V.GIRI, J\n                     -------------------\n                W.P.(C).12688\/2009\n                    --------------------\n         Dated this the 1st day of June, 2009\n\n                    JUDGMENT\n<\/pre>\n<p>      Ext.P1 notification was issued            by the<\/p>\n<p>respondent herein inviting tenders for         the work<\/p>\n<p>namely &#8220;construction of the District Collectors<\/p>\n<p>Bungalow at Painavu,              Idukki.&#8221;.   Petitioners<\/p>\n<p>obtained tender forms on 15.4.2009 and as per the<\/p>\n<p>notification, the last date for receipt of the tender is<\/p>\n<p>4.00 pm on 16.4.2009. They had delivered the<\/p>\n<p>tender forms for despatch               to the tendering<\/p>\n<p>authority on 15.4.2009 itself and in the normal<\/p>\n<p>course, same would have reached the respondent<\/p>\n<p>before 4.00 pm on 16.4.2009. It so happened that<\/p>\n<p>at the last moment the postal department declared<\/p>\n<p>16.4.2009 as a holiday, in connection with the<\/p>\n<p>polling to the Lok Sabha held on the same date. It<\/p>\n<p>is the admitted case that when the last date for<\/p>\n<p>receipt of tenders is declared as a holiday           or<\/p>\n<p>happens to be a holiday, then the last date for<\/p>\n<p>receipt of tenders         would automatically stand<\/p>\n<p>W.P.(C).12688\/2009<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>extended to the next working day. It is therefore,<\/p>\n<p>not disputed by the respondent that if the tenders<\/p>\n<p>had been delivered by 5.00 pm on 17.4.2009 then<\/p>\n<p>respondent      would have treated the same as one<\/p>\n<p>received in compliance with the tender notification.<\/p>\n<p>Paragraph 2 and 3 of the statement, filed by the<\/p>\n<p>respondent      read as follows:-\n<\/p>\n<\/p>\n<blockquote><p>               In the particular case only two<\/p>\n<p>         persons namely Sri.Shaji Thomas and<\/p>\n<p>         Sri.Manoj Scaria     has purchased the<\/p>\n<p>         tender documents from this office and<\/p>\n<p>         the above two persons        posted the<\/p>\n<p>         tender by speed post on 15.4.2009.<\/p>\n<p>         Even though the last date fixed for the<\/p>\n<p>         receipt of the tender document was on<\/p>\n<p>         16.4.2009,          due    to   election<\/p>\n<p>         proceedings this date was declared as<\/p>\n<p>         public holiday. Automatically the next<\/p>\n<p>         working day, ie., 17.4.2009 became<\/p>\n<p>         as the last date for the receipt of the<\/p>\n<p>         tender documents.\n<\/p><\/blockquote>\n<pre>               The   tender    documents    were\n\n         received    in  this   office only    on\n\nW.P.(C).12688\/2009\n<span class=\"hidden_text\">                            3<\/span>\n\n<\/pre>\n<blockquote><p>         18.4.2009, ie., after one day fixed for<\/p>\n<p>         the receipt of tender documents. Post<\/p>\n<p>         tender relaxation is not permitted due<\/p>\n<p>         t this and tenders received from Shaji<\/p>\n<p>         Thomas and Manoj Scaria were not<\/p>\n<p>         considered and not opened. No steps<\/p>\n<p>         have been taken to cancel the tender<\/p>\n<p>         notification and to re-tender the work.<\/p>\n<p>         it is submitted that the department has<\/p>\n<p>         no objection to accept these two<\/p>\n<p>         tenders if court direct accordingly as<\/p>\n<p>         the persons who purchased the tender<\/p>\n<p>         documents had submitted their offer.<\/p>\n<p>         There will be no chance for any other<\/p>\n<p>         claim in this regard.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<p>2.    Obviously,    it was open to the respondent to<\/p>\n<p>have treated the receipt of tenders as beyond the<\/p>\n<p>time mentioned in the tender notification, even if in<\/p>\n<p>the normal practice of extending the last date for<\/p>\n<p>receipt of tenders by one day,     was adopted in the<\/p>\n<p>present case.     But I take note of the fact that the<\/p>\n<p>petitioners alone had purchased the tender forms<\/p>\n<p>within the last date stipulated.      In other words,<\/p>\n<p>W.P.(C).12688\/2009<br \/>\n<span class=\"hidden_text\">                           4<\/span><\/p>\n<p>petitioners alone had responded        to the tender<\/p>\n<p>notification.       In the normal course of the<\/p>\n<p>proceedings, despatch of the tender forms on<\/p>\n<p>15.4.2009 would have ensured delivery within the<\/p>\n<p>time stipulated in the tender notification. In these<\/p>\n<p>circumstances,    especially taking note of the fact<\/p>\n<p>that nobody else      had responded to the tender<\/p>\n<p>notification and going by the statement filed by the<\/p>\n<p>respondent, which does not contain any objection in<\/p>\n<p>considering the tenders that had been received by<\/p>\n<p>him, I am of the view that the respondent shall<\/p>\n<p>proceed to consider the tenders submitted by the<\/p>\n<p>petitioners as having been received within the time<\/p>\n<p>stipulated. He shall then    proceed to process the<\/p>\n<p>same in accordance with its terms and conditions. I<\/p>\n<p>make it clear that the direction is intended only to<\/p>\n<p>require the respondent      to treat the tenders    as<\/p>\n<p>having been received in time and this direction<\/p>\n<p>need not be treated as an expression of opinion of<\/p>\n<p>this Court either as to the merits of the tender or as<\/p>\n<p>W.P.(C).12688\/2009<br \/>\n<span class=\"hidden_text\">                           5<\/span><\/p>\n<p>one requiring the tender processing authority     to<\/p>\n<p>necessarily accept the tender of any one of these<\/p>\n<p>persons.
