(C) No.830 of 2006)<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.    Challenge in this appeal is to the order passed by a<br \/>\nDivision Bench of the Madhya Pradesh High Court, dismissing<br \/>\nthe writ petition filed by the appellants.\n<\/p>\n<p>3.\tFactual background facts in a nutshell is as follows:\n<\/p>\n<p>The appellant No.2 herein invited applications for<br \/>\nseveral posts including the post of Cook by Employment\/<br \/>\nRecruitment Notice published in the Employment News<br \/>\ndated 19-25th October, 2002. The upper age limit in regard<br \/>\nto unreserved category candidate was mentioned as 25 yrs.<br \/>\nRespondent furnished his date of birth as 17.3.1978 and on<br \/>\nthat basis he was selected. The School Certificate and other<br \/>\nrecords showed the date of birth as 17.3 1977. Respondent<br \/>\nclaimed that he did not suppress any facts and he disclosed<br \/>\nall the material facts in regard to his date of birth and had<br \/>\nalso filed an affidavit stating that his date of birth was<br \/>\n17.3.1978 and he had sought for correction of date of birth<br \/>\nin the School Records. However, as he was found to be over<br \/>\n25 years, with reference to the date of birth in the School<br \/>\nRecords, though selected, he was not appointed.\n<\/p>\n<p>Feeling aggrieved by his non-appointment, though<br \/>\nselected, the Respondent herein filed O.A. No.322\/2003<br \/>\nbefore the Central Administrative Tribunal, Jabalpur Bench<br \/>\n(in short &#8216;CAT&#8217;)  seeking a direction to the appellants herein<br \/>\nto appoint him as Cook. One of the grounds urged by him<br \/>\nby amending the applications was that the Central Civil<br \/>\nServices and Civil Posts (Upper Age Limits for Direct<br \/>\nRecruitment) Rules, 1998 (&#8216;Rules&#8217; for short) which came into<br \/>\nforce on 1.4.1999 had increased the upper age limit for<br \/>\nrecruitment by the method of &#8220;Direct Open Competitive<br \/>\nExamination&#8221; to the Central Civil Services and Civil Posts<br \/>\nspecified in the relevant Service\/Recruitment Rules, by two<br \/>\nyears. He contended that he was entitled to the benefit of<br \/>\nsaid increase and if two years was added, he would fulfill<br \/>\nthe age recruitment even if the date of birth is taken as<br \/>\n17.3.1977.\n<\/p>\n<p>4.\tCAT allowed the application holding that the Rules<br \/>\napplied to the post for Cook for which the respondent had<br \/>\napplied and the applicant was entitled to relaxation by two<br \/>\nyears under the said rules and if such age relaxation is<br \/>\naccorded, his selection would be valid.\n<\/p>\n<p>5.\tAppellant questioned the correctness of the CAT&#8217;s order<br \/>\nby filing a writ petition which came to be dismissed by the<br \/>\nHigh Court of the impugned order.\n<\/p>\n<p>6.\tAppellants&#8217;s  stand before the High Court was that the<br \/>\nsaid rules applied only to recruitment through direct<br \/>\ncompetitive examination conducted by the Union Public<br \/>\nService Commission (in short &#8216;UPSC&#8217;) and the Staff Selection<br \/>\nCommission (in short &#8216;SCC&#8217;).  The recruitment in Indian Air<br \/>\nForce is not through Central Agency but by a Board<br \/>\nconstituted by the Commanding Officer of the Station\/Units<br \/>\nand, therefore, the Rules did not apply.\n<\/p>\n<p>7.\tThe High Court found that the recruitment was by direct<br \/>\nrecruitment though it was not by the UPSC\/SCC but authority<br \/>\nunder the Central Government.  Therefore, the CAT rightly<br \/>\nheld that the Rules were applicable.  The High Court found no<br \/>\nsubstance in the plea about the false declaration of age and<br \/>\nnon-applicability of the Rules.\n<\/p>\n<p>8.\tIn support of the appeal, learned counsel for the<br \/>\nappellant submitted that the admitted position is that<br \/>\naccording to his own affidavit, he has mentioned his date of<br \/>\nbirth to be 17.3.1978 and in the application form on the basis<br \/>\nof the matriculation certificate it was mentioned as 17.3.1977.<br \/>\nCAT accepted that the correction of date of birth could have<br \/>\nbeen done only by moving an appropriate application before<br \/>\nthe concerned authorities or the Education board.  Having so<br \/>\nobserved, the CAT held that this case is of relaxation.\n<\/p>\n<p>9.\tIt was contended that since the respondent himself did<br \/>\nnot claim any relaxation at any stage, and gave false<br \/>\ndeclaration about his age, therefore, the view of the CAT and<br \/>\nthe High Court is unsustainable.\n<\/p>\n<p>10.\tLearned counsel for the respondent on the other hand<br \/>\nsubmitted that there was no wrong declaration. In fact, in the<br \/>\nform and the affidavit both the dates were indicated.\n<\/p>\n<p>11.\tFrom the record it appears that the authority did not<br \/>\nissue any appointment order to the respondent on the ground<br \/>\nthat he gave a false date of birth.  Stand of the respondent<br \/>\nbefore CAT was that it appears from the application filed<br \/>\nbefore it is that the date of birth of the respondent is<br \/>\n17.3.1978. In an annexure he claimed it to be 17.3.1978. The<br \/>\nappellants knew about this date and, therefore, held him to be<br \/>\nqualified candidate and, therefore, he was interviewed by the<br \/>\nSelection Committee and found suitable.  Having proceeded in<br \/>\nthat manner it was not open to the appellants to deny<br \/>\nappointment.\n<\/p>\n<p>12.\tIt appears that the CAT itself accepted that the question<br \/>\nof correcting date of birth was not within the domain of the<br \/>\nappellants and it was open to the respondent to move<br \/>\nappropriate authority in that regard.  Having said so, CAT held<br \/>\nthat there was scope for relaxation.  There were no  pleadings<br \/>\nin that regard.   As a matter of fact, there is no reference even<br \/>\nto the relaxation aspect in the application before CAT.  For the<br \/>\nfirst time such stand was taken during the hearing before the<br \/>\nCAT. The High Court unfortunately did not consider this<br \/>\naspect.\n<\/p>\n<p>13.\tTherefore, the orders of the CAT and the High Court are<br \/>\nunsustainable and are quashed.  It will be open to the<br \/>\nrespondent to move to the authority for relaxation if he is so<br \/>\nadvised.  It shall be open to the authorities to pass appropriate<br \/>\norders in accordance with law.  We do not express any opinion<br \/>\nabout the acceptability or otherwise if prayer for relaxation is<br \/>\nmade.\n<\/p>\n<p>14.\tThe appeal is allowed to the aforesaid extent without any<br \/>\norder as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Union Of India &amp; Ors vs Shri Ramesh Singh Rajput on 14 December, 2007 Author: .
