The only aspects to be<br \/>\n\tconsidered is for interim injunction to the extent of liability<br \/>\n\tunder challenge of Rs. 2,25,000\/- together with proportionate<br \/>\n\tinterest and the cost.\n<\/p>\n<p>\t2.Rule<br \/>\n\treturnable on 13th June, 2007.  By ad-interim order,<br \/>\n\tthere shall be stay against execution and implementation of the<br \/>\n\taward qua applicant on condition that the applicant deposits the<br \/>\n\tentire amount of the award together with interest and the cost as<br \/>\n\tordered by the Tribunal (above referred admitted liability and the<br \/>\n\tliability under challenge coupled with proportionate interest and<br \/>\n\tcost) before the returnable date.  The amount deposited by the<br \/>\n\tapplicant with this Court shall be transmitted to the Tribunal.\n<\/p>\n<p>\tIt<br \/>\n\tprima facie appears that the Tribunal has permitted withdrawal of<br \/>\n\t40% on a higher side and investment of only 60%.  Normally, the<br \/>\n\tratio would be at the most 30% disbursement and 70% investment.<br \/>\n\tTherefore, the Tribunal shall disburse 30% of the awarded amount and<br \/>\n\tinvest 70% of the awarded amount both with proportionate interest<br \/>\n\tand cost to the extent of admitted liability. So far as the amount<br \/>\n\tpertaining to the liability under challenge is concerned, the order<br \/>\n\tof disbursement shall be passed at the time when the application is<br \/>\n\tfinalised.??\n<\/p>\n<p>Learned<br \/>\n\tMehta appearing for applicant ?  appellant submitted that total<br \/>\n\tamount as awarded by Tribunal together with cost and interest<br \/>\n\tincluding admitted liability is deposited with Tribunal by Insurance<br \/>\n\tCompany.\n<\/p>\n<p>This<br \/>\n\tCourt has allowed disbursement of 30% amount and 70% investment with<br \/>\n\tproportionate interest and cost to the extent of admitted liability,<br \/>\n\tbut no order is passed by this Court in respect to amount pertaining<br \/>\n\tto liability under challenged is concerned.  This Court has made it<br \/>\n\tclear that order of disbursement shall be passed at the time when<br \/>\n\tcivil application is finalized.\n<\/p>\n<p>Rule<br \/>\n\tissued by this Court is not received back.  The respondent claimants<br \/>\n\tare residing at State of Bihar, District Darbhanga Village Bharwada.<br \/>\n\tTherefore, issue fresh notice of Rule to respondent returnable on<br \/>\n\t1\/9\/2008.\n<\/p>\n<p>Therefore,<br \/>\n\tat this stage, though, notice is not received back for respondent<br \/>\n\tclaimants, this Court has passed order of disbursement in favour of<br \/>\n\trespondent claimants in respect to the amount pertaining to<br \/>\n\tliability under challenged by Insurance Company.\n<\/p>\n<p>The<br \/>\n\tClaims Tribunal is directed to pay 30% amount from liability under<br \/>\n\tchallenged in present appeal in favour of Smt Salma Khatoon urf<br \/>\n\tMarni by A\/c payee cheque and rest of amount is to be invested from<br \/>\n\tliability under challenged in any nationalize bank for a period of<br \/>\n\tfive years with cumulative interest and periodical renewal.\n<\/p>\n<p>The<br \/>\n\tFDR is in the name of respondent claimants to be remained with Nazir<br \/>\n\tdepartment of Tribunal.
