Respondents<\/pre>\n<pre>Coram:        Hon'ble Mr. Justice Rajesh Bindal\n\n\nPresent:      Mr. Jagdish Manchanda, Advocate, for the appellant.\n\n<\/pre>\n<p>              Mr. Navneet Singh, Assistant Advocate General, Haryana.\n<\/p>\n<p>Rajesh Bindal J.\n<\/p>\n<p>              The landowner has filed the present appeal before this court against<br \/>\nthe award of the learned court below passed under Section 18 of the Land<br \/>\nAcquisition Act, 1894 (for short, &#8216;the Act&#8217;) seeking enhancement of compensation<br \/>\nfor the acquired land.\n<\/p>\n<p>              Briefly, the facts of the case are that the State of Haryana vide<br \/>\nnotification dated 15.12.1982 issued under Section 4 of the Act, acquired the land<br \/>\nwithin the revenue estates of Villages Taraf Afgan, Ugra-Kheri and Malik Ugra-<br \/>\nKheri, Tehsil and District Panipat, for development and utilisation thereof as<br \/>\nresidential\/ commercial and Industrial area in Sectors 11, 12 and 25 (Phase-II), in<br \/>\nUrban Estate, Panipat. The Land Acquisition Collector assessed the market value<br \/>\nof the land at Rs. 59,200\/- per acre i.e. Rs. 370\/- per marla. On reference under<br \/>\nSection 18 of the Act, the learned court below determined the market value of the<br \/>\nacquired land @ Rs. 44\/- per square yard.\n<\/p>\n<p>              Learned counsel for the appellant submitted that the claim made by<br \/>\nthe appellant in the present appeal is squarely covered by a Division Bench<br \/>\njudgment of this court reported in <a href=\"\/doc\/205562\/\">Jogi Ram and others vs State of Haryana<\/a> 1997<br \/>\n(2) P.L.R. 303, whereby the compensation payable to the landowners was further<br \/>\nenhanced to Rs. 80\/- per square yard.\n<\/p>\n<p>              Learned Assistant Advocate General, Haryana, does not dispute this<br \/>\nfactual position.\n<\/p>\n<p>              For the detailed reasons recorded in Jogi Ram&#8217;s case (supra), the<br \/>\npresent appeal is allowed in the same terms.\n<\/p>\n<pre>28.1.2009                                               ( Rajesh Bindal)\nvs.                                                           Judge\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Smt.
