(ORAL)\n<\/pre>\n<p>             This appeal has been filed against the concurrent<\/p>\n<p>judgments of the Courts below decreeing the suit of the<\/p>\n<p>respondents for permanent injunction restraining the appellant<\/p>\n<p>from interfering in her possession over land measuring 5 kanals<\/p>\n<p>18 marlas on the ground that in a partition between two, the said<\/p>\n<p>land had fallen to the share of the respondent. The whole case of<\/p>\n<p>the appellant is that in fact partition did take place but the<\/p>\n<p>appellant never handed over possession to the respondent. Thus,<\/p>\n<p>at best the respondent could have filed suit for possession but<\/p>\n<p>could not file suit for permanent injunction. The following<\/p>\n<p>questions have been proposed:\n<\/p>\n<p>i) Whether     to   get   the   relief   of   permanent   injunction,<\/p>\n<p>  respondent\/plaintiff has to prove his possession over the suit<\/p>\n<p>  property?\n<\/p>\n<p><span class=\"hidden_text\"> RSA No.3153 of 2009                                       -2-<\/span><\/p>\n<p>ii)Whether the findings of the learned courts below are perverse<\/p>\n<p>  in nature especially when the same has been returned without<\/p>\n<p>  appreciating the documentary evidence placed on record by the<\/p>\n<p>  appellant\/defendant No.2?\n<\/p>\n<p>iii)Whether the judgments of both the courts below is not<\/p>\n<p>  sustainable as both the courts below failed to give any cogent<\/p>\n<p>  reasoning qua possession of respondent\/plaintiff?<\/p>\n<p>             It   could   be   seen   that   proposed   questions   are<\/p>\n<p>essentially questions of fact. Learned counsel has led large stress<\/p>\n<p>on one finding of the learned Lower Appellate Court in the<\/p>\n<p>following words:\n<\/p>\n<blockquote><p>                   &#8220;Moreover, in none of jamabandis after the year<br \/>\n             1981, defendant&#8217;s possession is mentioned as adverse<br \/>\n             rather defendants are shown to be in possession of<br \/>\n             half share of plaintiff as gair morusi tenants.&#8221;<\/p><\/blockquote>\n<p>             However, I find that the Lower Appellate Court, on a<\/p>\n<p>conspectus of the whole evidence, has correctly held that the<\/p>\n<p>parties were in possession as per the partition order Ex.P4 and<\/p>\n<p>the appellant had accepted that partition order.<\/p>\n<p>             Consequently, I am not persuaded to hold that the<\/p>\n<p>findings of the Courts below are either based on no evidence or is<\/p>\n<p>based on such misreading of evidence so as to render them so<\/p>\n<p>perverse as to be liable to interference under Section 100 of CPC.<\/p>\n<p>             Consequently, this appeal and application for stay are<\/p>\n<p>dismissed.\n<\/p>\n<\/p>\n<pre>August 28, 2009                                 (AJAY TEWARI)\nsonia                                               JUDGE\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Nawab Khan vs Smt.
