By this petition, the petitioner seeks a writ in the<br \/>\n       nature of certiorari to quash the order dated 02.12.2009<br \/>\n       (Annexure  P\/1) whereby the petitioner, posted  on<br \/>\n       deputation at Janpad Panchayat, Gariyaband, District<br \/>\n       Raipur  as Sub Engineer, has been repatriated to his<br \/>\n       parent department i.e. Water Resources Department.\n<\/p>\n<p>2.   The indisputable facts, in brief, are that the<br \/>\npetitioner is a Sub Engineer in Water Resources<br \/>\nDepartment. The petitioner, vide order dated 16.3.2007,<br \/>\nwas sent on deputation to the Panchayat and Rural<br \/>\nDevelopment Department and was posted as Sub Engineer at<br \/>\nProject Execution Unit No. 3, Pradhanmantri Gram Sadak<br \/>\nYojna, Baloda Bazar, Raipur. Thereafter, the petitioner<br \/>\nwas posted at Gariyaband vide order dated 13.06.2007<br \/>\n(Annexure P\/2). Under the rationalization scheme, the<br \/>\npetitioner was again posted at Lailunga, District Raigarh<br \/>\nvide order dated 01.10.2008 (Annexure P\/3).\n<\/p>\n<p>3.   Being aggrieved by the said order, the petitioner<br \/>\npreferred a writ petition before this Court being W.P.(S)<br \/>\nNo. 261\/2009 wherein by order dated 19.01.2009 (Annexure<br \/>\nP\/4), the co-ordinate Bench of this Court stayed the<br \/>\neffect and operation of the order dated 01.10.2008<br \/>\n(Annexure P\/3), till the next date of hearing.  W.P.(S)<br \/>\nNo. 261\/2009 was withdrawn by the petitioner on<br \/>\n10.07.2009. Accordingly, the same was dismissed as<br \/>\nwithdrawn. Thereafter, vide the impugned order dated<br \/>\n02.12.2009 (Annexure P\/1), the petitioner has been<br \/>\nrepatriated back to his parent department, which is<br \/>\ncontrary to the guidelines issued by the government vide<br \/>\nits circular dated 02.12.1988 (Annexure P\/5) as at the<br \/>\ntime of passing the impugned order, the consent of both<br \/>\nthe departments i.e. parent as well as borrowing<br \/>\ndepartment, has not been obtained.\n<\/p>\n<p>4.   Shri Soni, learned counsel appearing for the<br \/>\npetitioner submits that the impugned order has been<br \/>\npassed only to harass the petitioner and the same has<br \/>\nbeen passed with mala fide intention under the political<br \/>\ninfluence. Thus, this petition.\n<\/p>\n<p>5.   I have heard learned counsel appearing for the<br \/>\nparties, perused the pleadings and the documents appended<br \/>\nthereto.  Admittedly, in the present case, it is evident<br \/>\nthat the petitioner was sent on deputation by order dated<br \/>\n16.03.2007 and by order dated 02.12.2009 (Annexure P\/1),<br \/>\nthe petitioner was repatriated back to the parent<br \/>\ndepartment after completion of minimum period of two<br \/>\nyears.\n<\/p>\n<p>6.   <a href=\"\/doc\/1557293\/\">In Mohd. Masood Ahmad v. State of U.P. &amp; Others1,<br \/>\nthe Supreme Court<\/a> observed as under:\n<\/p>\n<blockquote><p>                &#8220;8. Learned counsel for the appellant<br \/>\n                submitted that the impugned  transfer<br \/>\n                order    of   the   appellant    from<br \/>\n                Muzaffarnagar  to  Mawana,   District<br \/>\n                Meerut was made at the instance of an<br \/>\n                MLA.   On the other hand, it has been<br \/>\n                stated in the counter-affidavit filed<br \/>\n                on behalf of respondents 1 and 2 that<br \/>\n                the  appellant  has been  transferred<br \/>\n                due  to  complaints against him.   In<br \/>\n                our  opinion, even if the  allegation<br \/>\n                of  the appellant is correct that  he<br \/>\n                was transferred on the recommendation<br \/>\n                of  an MLA, that by itself would  not<br \/>\n                vitiate  the  transfer order.   After<br \/>\n                all,   it   is   the  duty   of   the<br \/>\n                representatives of the people in  the<br \/>\n                legislature to express the grievances<br \/>\n                of  the  people and if there  is  any<br \/>\n                complaint  against  an  official  the<br \/>\n                State  government is certainly within<br \/>\n                its jurisdiction to transfer such  an<br \/>\n                employee.   There can be no hard-and-<br \/>\n                fast rule that every transfer at  the<br \/>\n                instance  of  an MP or MLA  would  be<br \/>\n                vitiated.   It  all  depends  on  the<br \/>\n                facts   and   circumstances   of   an<br \/>\n                individual case. In the present case,<br \/>\n                we  see  no infirmity in the impugned<br \/>\n                transfer order.&#8221;\n<\/p><\/blockquote>\n<p>  7.   The  law  on deputation is very clear. The Supreme<br \/>\n       Court in <a href=\"\/doc\/1180843\/\">State of Punjab and others vs. Inder Singh and<br \/>\n       others<\/a>2 while considering the deputation and repatriation<br \/>\n       to the parent cadre\/department on expiry of period of<br \/>\n       deputation observed as under :-\n<\/p>\n<blockquote><p>                &#8220;18.  The concept of &#8220;deputation&#8221;  is<br \/>\n                well  understood in service  law  and<br \/>\n                has     a     recognized     meaning.\n<\/p><\/blockquote>\n<blockquote><p>                &#8220;Deputation&#8221;    has    a    different<br \/>\n                connotation  in service law  and  the<br \/>\n                dictionary   meaning  of   the   word<br \/>\n                &#8220;deputation&#8221; is of no help. In simple<br \/>\n                words   &#8220;deputation&#8221;  means   service<br \/>\n                outside  the  cadre  or  outside  the<br \/>\n                parent   department.  Deputation   is<br \/>\n                deputing  or transferring an employee<br \/>\n                to  a post outside his cadre, that is<br \/>\n                to  say, to another department  on  a<br \/>\n                temporary  basis.  After  the  expiry<br \/>\n                period of deputation the employee has<br \/>\n                to come back to his parent department<br \/>\n                to occupy the same position unless in<br \/>\n                the meanwhile he has earned promotion<br \/>\n                in  his parent department as per  the<br \/>\n                Recruitment   Rules.   Whether    the<br \/>\n                transfer is outside the normal  field<br \/>\n                of  deployment or not is  decided  by<br \/>\n                the   authority  who   controls   the<br \/>\n                service   or  post  from  which   the<br \/>\n                employee is transferred. There can be<br \/>\n                no  deputation without the consent of<br \/>\n                the  person so deputed and he  would,<br \/>\n                therefore,   know  his   rights   and<br \/>\n                privileges  in  the deputation  post.\n<\/p><\/blockquote>\n<blockquote><p>                The    law    on    deputation    and<br \/>\n                repatriation is quite settled  as  we<br \/>\n                have  also  seen in various judgments<br \/>\n                which we have referred to above&#8230;..&#8221;\n<\/p><\/blockquote>\n<p>  8.   The Supreme Court in Umapati Choudhary v. State of<br \/>\n       Bihar and another3 has defined `deputation&#8217; in the<br \/>\n       following terms:-\n<\/p>\n<blockquote><p>                &#8220;Deputation can be aptly described as<br \/>\n                an    assignment   of   an   employee<br \/>\n                (commonly   referred   to   as    the<br \/>\n                deputationist) of one  department  or<br \/>\n                cadre   or   even   an   organization<br \/>\n                (commonly  referred to as the  parent<br \/>\n                department  or lending authority)  to<br \/>\n                another   department  or   cadre   or<br \/>\n                organization (commonly referred to as<br \/>\n                the    borrowing   authority).    The<br \/>\n                necessity  for sending on  deputation<br \/>\n                arises in public interest to meet the<br \/>\n                exigencies  of  public  service.  The<br \/>\n                concept  of  deputation is consensual<br \/>\n                and involves a voluntary decision  of<br \/>\n                the employer to lend the services  of<br \/>\n                his   employee  and  a  corresponding<br \/>\n                acceptance  of  such service  by  the<br \/>\n                borrowing employer. It also  involves<br \/>\n                the consent of the employee to go  on<br \/>\n                deputation or not.&#8221;\n<\/p><\/blockquote>\n<p>  9.   Further,  in  <a href=\"\/doc\/527418\/\">Kunal Nanda vs. Union of  India  and<\/a><br \/>\n       another4, the Supreme Court observed as under:\n<\/p>\n<blockquote><p>                &#8220;6..The  basic  principle  underlying<br \/>\n                deputation itself is that the  person<br \/>\n                concerned can always and at any  time<br \/>\n                be    repatriated   to   his   parent<br \/>\n                department  to serve any  substantive<br \/>\n                position  therein at the instance  of<br \/>\n                either  of the departments and  there<br \/>\n                is  no  vested right in such a person<br \/>\n                to continue for long on deputation or<br \/>\n                get  absorbed  in the  department  to<br \/>\n                which he had gone on deputation..&#8221;\n<\/p><\/blockquote>\n<p>  10.  The  Supreme  Court in <a href=\"\/doc\/31592\/\">Prasar Bharti  &amp;  Ors.  vs.<br \/>\n       Amarjeet Singh &amp; Ors5.<\/a> observed that;\n<\/p>\n<blockquote><p>                  &#8220;13.  There  exists  a  distinction<br \/>\n                between  `transfer&#8217; and `deputation&#8217;.<br \/>\n                `Deputation&#8217; connotes service outside<br \/>\n                the   cadre  or  outside  the  parent<br \/>\n                department  in which an  employee  is<br \/>\n                serving.   `Transfer&#8217;,  however,   is<br \/>\n                limited  to  equivalent post  in  the<br \/>\n                same    cadre   and   in   the   same<br \/>\n                department. Whereas deputation  would<br \/>\n                be  a  temporary phenomenon, transfer<br \/>\n                being  antithesis  must  exhibit  the<br \/>\n                opposite indications.&#8221;\n<\/p><\/blockquote>\n<p>  11.  Applying  the well settled principles  of  law  on<br \/>\n       deputation to the facts of the case, continuation of the<br \/>\n       employees on deputation or repatriation on completion of<br \/>\n       deputation period does not depend on their consent. After<br \/>\n       completion  of  minimum period of deputation,  the<br \/>\n       petitioner\/employee may be repatriated back to the parent<br \/>\n       department.\n<\/p>\n<p>12.  In view of foregoing and for the reasons mentioned<br \/>\nhereinabove, no interference is warranted with the order<br \/>\ndated 02.12.2009 (Annexure &#8211; P\/1).
