No.13335 of 2008\n                                      VIKASH SINGH\n                                         Versus\n                                   THE STATE OF BIHAR\n                                      -----------\n<\/pre>\n<p>4\/         08.07.2008                     Since both the above bail applications have arisen out of one<\/p>\n<p>                          Barhia P.S. Case No. 144 of 2007 they have been heard together and are being<\/p>\n<p>                          disposed of by this common order.\n<\/p>\n<p>                                          The case under Sections 147, 148, 149, 307, 353 and 302 of the<\/p>\n<p>                          Indian Penal Code and under Sections 25(1-B) A\/26\/27\/35 of the Arms Act was<\/p>\n<p>                          registered against these two petitioners.\n<\/p>\n<p>                                          According to the allegation the criminals have assembled when<\/p>\n<p>                          the police arrived then they started firing. In exchange of firing five associates of<\/p>\n<p>                          Mukesh Singh and one Tun Tun Singh @ Pahalwan were killed. From the place<\/p>\n<p>                          of occurrence huge quantity of fire arms and cartridges were also recovered.<\/p>\n<p>                                          Submission is that the petitioners are land holders and they have<\/p>\n<p>                          no concern with any Mukesh Singh or his gang. No persons were injured on<\/p>\n<p>                          behalf of police. Petitioners are of fair antecedent.<\/p>\n<p>                                          Considering the facts and circumstances of the case, the<\/p>\n<p>                          petitioners Markendey Pandey in Cr. Misc. No. 6851 of 2008 and Vikash Singh<\/p>\n<p>                          in Cr. Misc. No. 13335 of 2008 are ordered to be released on bail on furnishing<\/p>\n<p>                          bail bond of Rs. 10,000\/- (ten thousand) each with two sureties of the like<\/p>\n<p>                          amount each to the satisfaction of the A.C.J.M., Lakhisarai in connection with<\/p>\n<p>                          Barhia P.S.
