Justice M.C.HARI RANI\n\n Dated :23\/09\/2010\n\n O R D E R\n               K.M.JOSEPH &amp; M.C.HARI RANI, JJ.\n         ------------------------------------------------------\n                  W.P.(C) No.29374 of 2010-V\n             ----------------------------------------------\n           Dated, this the 23rd day of September, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>              The prayers in the writ petition are as follows:<\/p>\n<p>     &#8220;i). to issue a writ of mandamus or other appropriate writ,<\/p>\n<p>     direction or order directing respondents 8 to 12 to render<\/p>\n<p>     adequate    protection    to  the   petitioner and   church<\/p>\n<p>     properties.\n<\/p>\n<p>     ii) to issue a writ of mandamus or other appropriate writ,<\/p>\n<p>     direction or order directing the respondents 8 to 12 to take<\/p>\n<p>     effective   and    immediate     action    on  Exhibit   P9<\/p>\n<p>     representation.&#8221;\n<\/p>\n<p>              2. Briefly put, the case of the petitioner is that<\/p>\n<p>petitioner is an evangelist and the Divisional Overseer of &#8216;the<\/p>\n<p>Society Church of God. The most important aim of the church<\/p>\n<p>is the gospel work. Petitioner got ordained by issuing Bishop<\/p>\n<p>certificate as per Ext.P2. By Ext.P3, the Field Director of the<\/p>\n<p>church of God Asia\/Pacific has extended the tenure of the<\/p>\n<p>office till August 31, 2010.     Ext.P4 is the extension certificate<\/p>\n<p>allegedly issued by the highest authority of the church. There<\/p>\n<p><span class=\"hidden_text\">WPC 29374\/2010                     -2-<\/span><\/p>\n<p>is allegation about Ext.P5, the alleged letter sent to the<\/p>\n<p>petitioner by the Ist respondent contending false allegations.<\/p>\n<p>Petitioner filed Ext.P6 suit O.S.No.460\/2010 and Ext.P7<\/p>\n<p>application for temporary injunction.       The Munsiff court,<\/p>\n<p>Kottayam has appointed an Advocate Commissioner. Ext.P8 is<\/p>\n<p>the commission report in the suit filed by the petitioner.<\/p>\n<p>Thereafter, it is stated that respondents 1 to 7 are obstructing<\/p>\n<p>the petitioner from performing his official duties. It is also<\/p>\n<p>stated that they have given threat to his body.           As the<\/p>\n<p>petitioner is the divisional overseer  he has to go to different<\/p>\n<p>parts    of the world, it is stated.     Petitioner filed Ext.P9<\/p>\n<p>representation.\n<\/p>\n<p>            3.     We heard the learned counsel for the<\/p>\n<p>petitioner. After going through the writ petition we are not<\/p>\n<p>convinced that the petitioner has made out a case for this<\/p>\n<p>Court to exercise the extra ordinary jurisdiction.      Petitioner<\/p>\n<p>has already instituted a civil suit. An interlocutory application<\/p>\n<p>is also pending consideration. At this stage, we do not think<\/p>\n<p>that it is appropriate for this Court to interfere in the matter.<\/p>\n<p>We relegate the petitioner to pursue his remedies before the<\/p>\n<p><span class=\"hidden_text\">WPC 29374\/2010                   -3-<\/span><\/p>\n<p>civil Court.
