Sivasubramaniam, J.<\/p>\n<p>1. The petitioner prays for writ of Certiorari to call and quash the orders passed in C.A.No.18\/1994 dated 23.1.1995, on the file of District and Sessions Judge, North Arcot Ambedkar District, Vellore. The Writ Petition has been filed by the State of Tamil Nadu.\n<\/p>\n<p>2. On 20.12.1992 at about 8.30pm the Forest Ranger and his party, while they were watching the movements in the forest noticed one Mahindra van, bearing Reg. No.TN-01-B-9396, 100 metres away from the Kelur R.F. in Polur Range on Arani Polur Highways gave a signal. On seeing the signal two persons emerged from the Eucalyptus plantations in the Kelur R.F., beat and reached the van. The second accused alighted from the van and after a brief talk, reversed the van in the said plantation. Few minutes thereafter they heard the sound of loading sandalwood and closing the doors of the van. The party rushed to the spot in a jeep and intercepted the said van when they were about to reach the main road. They were able to secure A-1 and A-2. On search, they found sandalwood weighing about 646 kgs worth Rs.33,076\/-. The seizure of the sandalwood was effected and as the van had no valid documents, the accused 1 and 2 were arrested at 10.50pm. A case was registered under Section 21(d) and 35(b), 36(a) and (e)and Rule 3 and 1 of Tamil Nadu Sandalwood possession Rules 1970. The seized materials were produced before the Forest officer on 30.12.1992. The accused were produced before the said Judicial Magistrate Thirupathur on 30.12.1992 and they were remanded to judicial custody. Confiscation proceeding under Section 49(A) of Tamil Nadu Forest Act was initiated and the registered owner of the vehicle B.Nagarajan, the first respondent filed petition for the release of the said van through his counsel on 29.3.1993. After providing sufficient opportunities and after the accused refused to receive the notice, the Forest Officer examined all the materials placed before him and ordered confiscation of the van. As against the said order, an appeal in Criminal Appeal no.18 of 1994 was preferred challenging the order of confiscation. The said appeal was allowed by the learned District and Sessions Judge North Arcot Ambedkar District and the present Writ Petition has been filed against the same.\n<\/p>\n<p>3. The learned Government Pleader appearing for the State contends that the only ground on which the appeal was allowed was that the second respondent namely the financier had not been impleaded in the complaint and has also not been served with the complaint and no show cause notice had been issued to the financier and therefore, the entire proceedings were vitiated.\n<\/p>\n<p>4. According to the learned counsel, the first respondent is the owner of the vehicle in terms of Section 49(b) and therefore the proceedings initiated as against the owner of the vehicle is sufficient. Even otherwise the learned District Judge ought to have remanded the matter to the Enquiry Authority and could have directed the State to issue notice to the Financier. The learned District Judge ought not to have allowed the appeal only on the ground of absence of notice to the financier.\n<\/p>\n<p>5. The learned counsel for the respondent however relies on the judgment of AR. Lakshmanan, J. as he then was in District Forest Officer, Attur Salem Vs. A.V. Ravichandran &amp; another reported in 1996 (II) CTC 34, in support of his contention that a Writ Petition was not maintainable at the instance of the District Forest Officer. It is further contended that the financier is the real owner of the vehicle, until the ownership of the vehicle is fully transferred in the name of the purchaser and till then, the financier is the real owner of the property.\n<\/p>\n<p>6. In reply, the learned Government Pleader contends that the above judgment of AR.Lakshmanan, J., though upheld by a Division Bench of this court in W.A. No.461 of 1996 dated 20.6.1996, (The District Forest Officer Attur Salem, Vs. A.V. Ravichandran and another), the Division Bench approved the said conclusion only as a result of absence of sanction by the government to file the Writ Petition in that case.\n<\/p>\n<p>7. I have considered the submissions of the both sides. In the context of the maintainability of the Writ Petition, the judgment of AR.Lakshmanan, J. as mentioned above was the subject matter of writ appeal as aforesaid. The Division Bench though had dismissed the writ appeal, made it clear that it was open to the State Government to authorise the Forest Officer to file an appeal. On the facts of that case, no such authorisation of the State Government was shown in favour of the Forest Officer and hence the writ appeal was dismissed. In the present case, the Writ Petition having been filed by the State Government itself, the said objection by the learned counsel for the respondent cannot be sustained.\n<\/p>\n<p>8. Now coming to the question as to whether notice should have been issued to the second respondent or not, it is seen that the second respondent is a financier. The learned counsel for the petitioner relies on the provisions of Section 49(b) of the Act, which requires notice being given in writing to the registered owner thereof. In cases of vehicles under hire purchase agreement, or for that matter any goods under any hire purchase agreement, until the vehicle or goods are fully transferred in favour of the owner, the financier shall be deemed to be the owner of the vehicle. Under civil law, the ownership will continue to vest with the financier until all the dues to him are paid and the purchaser would become the owner only after due transfer. Therefore, it is always desirable in such cases to send notices to both the financier and the purchaser. In this case, at the appellate state, the financier has come on record. No prejudice would have been caused if the District Judge had remanded the matter for reissue of notice to the second respondent also and for due enquiry. The order of the learned District Judge allowing the appeal in entirety cannot be sustained. The appeal before the District Court in these cases are statutory appeals under the Forest Act, dealing with offences against the society and the culprits cannot be allowed to go free only due to absence of notice to financier, which defect can be rectified by issuing notice to him and hearing him.\n<\/p>\n<p>K.P. Sivasubramaniam, J.\n<\/p>\n<p>9. With the result, the above Writ Petition is allowed. The Authorised Officer cum Conservator of Forests having jurisdiction however area shall issue a proper notice to both the purchaser and the financier and proceed afresh against them in accordance with law. The Writ Petition is ordered in the above terms. No costs.
