M. Prachchhak, learned<br \/>\n\tadvocate for the appellants in both these appeals.  Both the appeals<br \/>\n\tarise out of common judgement and decree passed by the learned<br \/>\n\tAdditional District Judge, Porbandar and common questions are<br \/>\n\tinvolved in both the appeals.\n<\/p>\n<p>Having<br \/>\n\tregard to the submissions made by the learned advocate for the<br \/>\n\tappellants, the matters require consideration.  Hence, ADMIT.<br \/>\n\t The following substantial questions of law arise for determination<br \/>\n\tin both these appeals.\n<\/p>\n<p>&#8220;[1]\tWhether<br \/>\nthe judgement and decree passed by the<br \/>\nlower Appellate Court is vitiated by not framing the points for<br \/>\ndetermination as required under Order 41 Rule 31 of the Code of Civil<br \/>\nProcedure, 1908 ?\n<\/p>\n<p>[2]\tWhether<br \/>\nthe lower Appellate Court was justified in reversing the judgement<br \/>\nand decree passed by the Trial Court without considering and<br \/>\nrecording any finding on the issue of non-joinder of necessary<br \/>\nparties as was considered by the Trial Court?\n<\/p>\n<p>[3]\tWhether<br \/>\nthe subsequent suit filed by the plaintiffs was barred by the<br \/>\nprovisions of Order 2 Rule 2 of the Code of Civil Procedure, 1908 and<br \/>\nthe proviso to section 34 of the Specific Relief Act, 1963?\n<\/p>\n<p>[4]\tWhether<br \/>\nthe lower Appellate Court was justified in allowing the appeal<br \/>\nwithout specifying the nature of reliefs to be granted in favour of<br \/>\nthe opponents &#8211;
