KRISHNAN, J\n                        -----------------------\n                    CRL.R.P.No. 289 OF 2006\n                   ---------------------------------\n             Dated this the 19th day of December, 2008\n\n\n                              O R D E R\n<\/pre>\n<p>     This Revision is preferred against the judgment in Criminal<\/p>\n<p>Appeal No. 1116\/2004 of the Sessions Judge, Ernakulam. The said<\/p>\n<p>appeal was preferred against the conviction and sentence passed by<\/p>\n<p>the Judicial First Class Magistrate-I, Ernakulam in C.C. No.<\/p>\n<p>1486\/2000. The trial court found the accused guilty and directed<\/p>\n<p>him to undergo Simple Imprisonment for a period of one month and<\/p>\n<p>to pay Rs. 2,43,472\/- as compensation under Section 357(3) of<\/p>\n<p>Criminal Procedure Code.        The appellate court modified the<\/p>\n<p>sentence to imprisonment till the rising of the court and to pay<\/p>\n<p>compensation of Rs. 1,25,000\/- and in default to undergo Simple<\/p>\n<p>Imprisonment for three months.          By virtue of my order in<\/p>\n<p>Crl.M.Appl. No. 12633\/08, the matter has been compounded and<\/p>\n<p>therefore it necessitates to set aside the conviction and sentence<\/p>\n<p>entered into by the courts below. Therefore the conviction and<\/p>\n<p>sentence passed by the courts below are set aside. Recording of a<\/p>\n<p>compromise will have the effect of an acquittal under Section 320<\/p>\n<p>(8) of the Criminal Procedure Code.\n<\/p>\n<p>Crl.R.P.No. 289\/2006<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>      Therefore the accused is acquitted and set at liberty. Since<\/p>\n<p>the matter is already compounded, the amount of Rs. 30,000\/-<\/p>\n<p>deposited by the revision petitioner before the trial court shall be<\/p>\n<p>returned to him on appropriate application.<\/p>\n<p>      The Crl. R.P. is disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                            M.N.
