CR No. 248 of 2011 registered at Kathlal Police Station<br \/>\nfor the offence punishable under Sections 66(1) (B), 65-E and 81 of<br \/>\nthe Indian Penal Code.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr. Chirag Parekh appearing on behalf of the applicant<br \/>\nsubmitted that the applicant is an innocent person and he has been<br \/>\nwrongly arraigned in the offence. From the bare reading of the FIR,<br \/>\nprima facie, it is established that there is no role reflected on the<br \/>\npart of the applicant.  Therefore, the applicant may kindly be<br \/>\nreleased on bail by imposing suitable conditions.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Ms. Shah strongly opposed the application of the applicant and<br \/>\nstated that looking to the fact the applicant is involved in serious<br \/>\noffence as alleged, gravity of the office, quantum of punishment,<br \/>\ndiscretion may not be exercised in favour of the applicant.\n<\/p>\n<p>5.\tHaving<br \/>\nconsidered the rival submissions and on perusal of the role<br \/>\nattributed to the applicant as reflected in the FIR, police papers,<br \/>\nquantum of punishment, etc. and the fact that prima facie, there is<br \/>\nno allegation established against the applicant, I am of the view<br \/>\nthat the applicant deserves to be enlarged on bail. At this stage of<br \/>\nbail, this Court is not discussing the evidence in detail.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith Prohi. CR No. 248 of 2011 registered at Kathlal Police Station<br \/>\non his executing a bond of Rs.10,000\/- [Rupees ten thousand only]<br \/>\nwith one surety of the like amount to the satisfaction of the Trial<br \/>\nCourt and subject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[f]\tshall<br \/>\nmark his presence on 15th day of every calender month<br \/>\nbefore the concerned police station, till the trial is over;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>9.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>10.\tRule<br \/>\nis made absolute to the aforesaid extent.
