SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/02\/2006 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tRule.\n<\/p>\n<p>Mr.Hardik Raval, learned advocate waives the service of rule on<br \/>\nbehalf of the opponent.\n<\/p>\n<p>2.\t\tBy<br \/>\nway of this application, the applicant ?  original respondent has<br \/>\nprayed to modify the order dtd.14\/6\/2005 passed by this Court in<br \/>\nSpecial Civil Application No.1750 of 2005 to the extent of deleting<br \/>\nthe sentence by which it is recorded in the order that the respondent<br \/>\nworkman has expired during the pendency of the present petition.\n<\/p>\n<p>3.\t\tMr.Rathod,<br \/>\nlearned advocate appearing on behalf of the applicant has submitted<br \/>\nthat the report of the Baliff was based upon the Death Certificate<br \/>\nof another person and by mistake and through over sight, the Baliff<br \/>\nhas made report that the applicant has expired. Mr.Rathod has<br \/>\nsubmitted that even the applicant is personally present before this<br \/>\nCourt and he identifies him. He has also produced xerox copy of the<br \/>\nTalati Cum-Mantri, Mota Liliya Gram Panchayat to the effect that the<br \/>\napplicant is still alive. Under the circumstances, it appears that<br \/>\nthere was some bonafide mistake on the part of the Baliff who has<br \/>\nmade a report earlier that the applicant has expired.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above,  the order passed by this Court dtd.14\/6\/2005 in<br \/>\nSpecial Civil Application No.1750 of 2005 is modified to the extent<br \/>\nthat in the last 9th line of the said order, the sentence<br \/>\n?SIt is required to be noted that during the pendency of the present<br \/>\nSpecial Civil Application the respondent workman has expired.??  is<br \/>\nordered to be deleted. Office to issue fresh writ accordingly. Rule<br \/>\nis made absolutely to the aforesaid extent.
