Misc. No.6329 of 2011\n                  LALLU YADAV son of late Devendra Yadav\n                                   Versus\n                          THE STATE OF BIHAR\n                                 -----------\n<\/pre>\n<p>2\/   17.03.2011                Heard learned counsel for the petitioner and the State.<\/p>\n<p>                               The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under sections 302 and other allied sections of the Indian<\/p>\n<p>                  Penal Code.\n<\/p>\n<p>                               It has been submitted that no specific overt act has been<\/p>\n<p>                  alleged against the petitioner, who was merely a member of mob.<\/p>\n<p>                               Considering the same as also that the petitioner is in<\/p>\n<p>                  custody since 11.1.2011 and has fair antecedents, let the petitioner,<\/p>\n<p>                  above named, be released on bail on furnishing bail bond of<\/p>\n<p>                  Rs.5,000\/- (five thousand) with two sureties of the like amount each<\/p>\n<p>                  or any other surety to be fixed by the court below to the satisfaction<\/p>\n<p>                  of the Chief Judicial Magistrate, Purnea, in connection with Barhara<\/p>\n<p>                  P.S. Case No.76 of 2010, subject to the conditions (i) That one of<\/p>\n<p>                  the bailors will be a close relative of the petitioner, who will give an<\/p>\n<p>                  affidavit giving genealogy as to how he is related with the petitioner<\/p>\n<p>                  and another bailor shall be the son of the petitioner. The bailors will<\/p>\n<p>                  undertake to furnish information to the court about any change in the<\/p>\n<p>                  address of the petitioner, (ii) That the affidavit shall clearly state that<\/p>\n<p>                  the petitioner is not an accused in any other case and, if he is, he<\/p>\n<p>                  shall not be released on bail, (iii) That the bailors shall also state on<\/p>\n<p>                  affidavit that they will inform the court concerned if the petitioner is<\/p>\n<p>                  implicated in any other case of similar nature after his release in the<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>       present case and thereafter the court below will be at liberty to<\/p>\n<p>       initiate the proceeding for cancellation of bail on the ground of<\/p>\n<p>       misuse, (iv) That the petitioner will give an undertaking that he will<\/p>\n<p>       receive the police papers on the given date and be present on date<\/p>\n<p>       fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>       delays the trial in any manner, his bail will be liable to be cancelled<\/p>\n<p>       for reasons of misuse, and (v) That the petitioner will be well<\/p>\n<p>       represented on each date and if he fails to do so on two consecutive<\/p>\n<p>       dates, his bail will be liable to be cancelled.\n<\/p>\n<\/p>\n<pre>JA\/-                                            (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Lallu Yadav vs The State Of Bihar on 17 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
