Justice M.L.JOSEPH FRANCIS\n\n Dated :22\/07\/2010\n\n O R D E R\n           K.M.JOSEPH &amp; M.L.JOSEPH FRANCIS, JJ.\n         ------------------------------------------------------\n                 W.P.(C) No.22127 of 2010-M\n            ----------------------------------------------\n             Dated, this the 22nd day of July, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>             Petitioner has approached this Court seeking the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote><p>    &#8220;i.  to issue a writ order or direction in the nature of<\/p>\n<p>    mandamus or other appropriate writ directing respondents<\/p>\n<p>    2 to 5 or the concerned among them to render adequate<\/p>\n<p>    and meaningful police protection to the petitioner in the<\/p>\n<p>    matter of his life and in the matter of his running of office<\/p>\n<p>    at   Door    No.6,    Kolatheri   Towers,    Valanjambalam,<\/p>\n<p>    Ernakulam in the basement floor against acts of violences,<\/p>\n<p>    threats, intimidations, assaults and other commissions<\/p>\n<p>    from the end of respondents 10 to 12 and persons under<\/p>\n<p>    them.\n<\/p><\/blockquote>\n<blockquote><p>    ii. to issue a writ order or direction in the nature of<\/p>\n<p>    mandamus or other appropriate writ, directing respondents<\/p>\n<p>    6 to 9 or the concerned among them to render adequate<\/p>\n<p>    and meaningful police protection to the petitioner and his<\/p>\n<p>    family members in the matter of his life and residence in<\/p>\n<p>    the residential building known as Purayidathil House, Near<\/p>\n<p>    School Ground, Vadavukodu, Puthencruz, against acts of<\/p>\n<p>    violences, threats, intimidations, assaults and other<\/p>\n<p><span class=\"hidden_text\">WPC 22127\/2010                                -2-<\/span><\/p>\n<p>    commissions from the end of respondents 10 to 12 and<\/p>\n<p>    persons under them.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>            The further prayer     is for a direction to     take<\/p>\n<p>decision on Ext.P1 and P3.<\/p><\/blockquote>\n<p>            2.   Briefly put, the case of the petitioner is as<\/p>\n<p>follows: Petitioner is a Law Graduate engaged in Chamber<\/p>\n<p>practice. He availed a loan for purchasing property of the 10th<\/p>\n<p>respondent.     According to him, the entire purchase price was<\/p>\n<p>given to the 10th respondent. There is a reference to some<\/p>\n<p>dispute, and the further allegation is against respondents 10<\/p>\n<p>to 12 of using force. There is allegation of threat to life.<\/p>\n<p>            3.   Today, when the matter came up, learned<\/p>\n<p>counsel appearing on behalf of respondents 10 to 12 Sri.Raju<\/p>\n<p>P.Mathews would deny the allegations.         According to him<\/p>\n<p>amounts are due from the petitioner to the 10th respondent.<\/p>\n<p>He would submit that legal proceedings is being taken and<\/p>\n<p>there will be no threat to the petitioner as apprehended by<\/p>\n<p>him. We record the above submission and dispose of the writ<\/p>\n<p>petition. In case there is any threat from respondents 9 to 12<\/p>\n<p>to the life of the petitioner and it is brought to the notice of<\/p>\n<p><span class=\"hidden_text\">WPC 22127\/2010                            -3-<\/span><\/p>\n<p>respondents 4 and 5 or either of them they shall take<\/p>\n<p>appropriate action for granting protection to the life of the<\/p>\n<p>petitioner.
