NO. 1275 OF 2008\n              = = = = = = = = = = = = = = =\n         Dated this the 15th day of March, 2010.\n\n                       J U D G M E N T\n<\/pre>\n<p>      This appeal is preferred against the award of the Motor<\/p>\n<p>Accidents Claims Tribunal, Kottayam in O.P.(MV)515\/03. The<\/p>\n<p>claimant a pillion rider sustained injuries in a road accident<\/p>\n<p>and he is awarded a compensation of Rs.27000\/- and the<\/p>\n<p>insurance company was directed to pay the amount. The<\/p>\n<p>vehicle was covered by a package policy.        The insurance<\/p>\n<p>company has come up in appeal contending for the position<\/p>\n<p>that as no additional premium is paid for the coverage of a<\/p>\n<p>pillion rider the insurance company is not liable to pay the<\/p>\n<p>amount.     Now by virtue of the clarificatory circular dated<\/p>\n<p>16.11.2009 of the Insurance Regulatory and Development<\/p>\n<p>Authority    insurance  company&#8217;s   liability  in  respect  of<\/p>\n<p>passengers carried in a private vehicle and persons carried in<\/p>\n<p>a two wheeler are covered under the terms and conditions of<\/p>\n<p>Standard Motor Package Policy. The conditions of policy has<\/p>\n<p>come up for consideration before two Division Benches of<\/p>\n<p>M.A.C.A. 1275 OF 2008<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>this Court in the decisions reported in <a href=\"\/doc\/135962\/\">New India<\/p>\n<p>Assurance Co. Ltd. v. Hydrose<\/a> (2008 (3) KLT 778) and<\/p>\n<p><a href=\"\/doc\/1457758\/\">Mathew v. Shaji Mathew<\/a> (2009 (3) KLT 813). On a<\/p>\n<p>consideration of the materials this Court held that the terms<\/p>\n<p>and conditions of the policy cover the risk of a pillion rider.<\/p>\n<p>Therefore by virtue of the clarificatory Circular as well as by<\/p>\n<p>virtue of the decisions referred to above it has to be held<\/p>\n<p>that the liability of the insurance company cannot be found<\/p>\n<p>against and it is liable. So the appeal lacks merit and the<\/p>\n<p>same is dismissed.\n<\/p>\n<\/p>\n<p>                            M.N.
