DAVE\n\t\t\n\t\n\n \n\nDate\n: 30\/08\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with First Information Report registered as<br \/>\nI-C.R. No. 76 of 2011 with Prantij Police Station, Dist. Sabarkantha<br \/>\nfor the offences punishable under Sections 452, 394, 397, 328 of the<br \/>\nIndian Penal Code and Section 25(1)(c)(1-b) of the Arms Act and<br \/>\nSection 135 of the Bombay Police Act.\n<\/p>\n<p>2.\tLearned<br \/>\nCounsel appearing for the applicant submitted that the applicant is a<br \/>\nstudent who has completed his Diploma in Electrical Engineering and<br \/>\neven offered a placement as Junior Engineer (Trainee) by a reputed<br \/>\ncompany. It is further a case of the applicant that there is no<br \/>\nantecedent and                 co-accused is considered for the bail<br \/>\nby this Court and hence, by imposing suitable conditions for securing<br \/>\npresence during trial, the applicant may be enlarged on bail.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned APP Mrs. Manisha L. Shah for the respondent-State.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned Counsels for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the applicant, by imposing suitable<br \/>\nconditions, I deem it just and proper to enlarge the applicant on<br \/>\nbail.\n<\/p>\n<p>5.\tLearned<br \/>\nCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith First Information Report registered as I-C.R. No. 76 of 2011<br \/>\nwith Prantij Police Station, Dist. Sabarkantha on executing a bond of<br \/>\nRs.5,000\/- (Rupees Five Thousand Only) with one surety of the like<br \/>\namount to the satisfaction of the Trial Court and subject to the<br \/>\nconditions that he shall;\n<\/p>\n<p>a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p>b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>c)<br \/>\n\tsurrender his passport, if any, to the lower court within a week;\n<\/p>\n<p>d)<br \/>\n\tnot leave the State of Gujarat without prior permission of the<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p>e)<br \/>\n\tmark presence at the concerned Police Station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>f)<br \/>\n\tfurnish the present address of his residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p>7.\tThe<br \/>\nauthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>10.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
