said Onkarswarny in the motor <\/p>\n
occurred at about 11.45   <\/p>\n
petition was contested  ‘i-n_surer’-of the lony
\ninteralia on the ground llthvecvideceased was a<\/p>\n
gratutous passengerrfi travelling-.’_ir1V’   goods carriage,<\/p>\n
therefore,   not liable to indemnify the
\ninsured respec-idof “claim arising out of the said<\/p>\n
accident.\n<\/p>\n
   xThe””l’ri’b’unal by its judgment and award<\/p>\n
  dated   while answering Point No.1 held that<\/p>\n
the:  Onkaraswarny was travelling as an<\/p>\n
 unatrthorised passenger in goods carriage. The<\/p>\n
l’ –..Trihunal on the basis of evidence on record quanti\ufb01ed<\/p>\n
  …..the compensation at Rs.2,25,000\/– and in the light of<\/p>\n

\nthe findings on Point No.1 held that, the insurer is not<\/p>\n
liable to indemnify the insured, consequently, the claim
\npetition as against Respondent No.2–Insurance<\/p>\n
Company came to be dismissed and the owner of\u00bb the<\/p>\n
iorry was directed to pay the entire <\/p>\n
amount. Subsequently, the claimants  <\/p>\n
under Order 47 Rules 1 and 2   of<\/p>\n
the judgment and award passedllvbylithe ‘i’ri.bt1’nallV<\/p>\n
far as it relates to dismissallo’f..:the c1aimp’etition against
\nthe Insurance Company. Thei petition was<\/p>\n
contested ‘appellantQlnlsurance Company inter
\nalia onthe  petition is not rnaintajnable<\/p>\n
in the _ light ..:lof”.thel” speci\ufb01c \ufb01nding recorded by the<\/p>\n
 its jiidgment that the deceased was an<\/p>\n
 anaatho-risedgpassenger travelling in the goods carriage<\/p>\n
and th-erefore, the petition was sought to be dismissed.<\/p>\n
 A.  4’)? The learned Member of the Tribunal,<\/p>\n
however, by the order under appeal placing reliance on<\/p>\n
 several decisions \u00e9ited, held that the insurance<\/p>\n

\nCompany at the first instance should pay the award<\/p>\n
amount and thereafter, the Insurance Company is at
\nliberty to recover the amount from the owner. In that
\nView of the matter, the Tribunal allowed the preview<\/p>\n
petition and directed the appe11ant–Insnrancf’\u00e9..\u00e9onipany<\/p>\n
to pay the award amount with liberty <\/p>\n
same from the owner of the vehviciief ‘Being-:<\/p>\n

  fall  any one of the grounds on which<\/p>\n
    review its judgment under Order 47<\/p>\n

#5}: Upon service of notice of this appeal, the<\/p>\n
A’ re\u00bbspxondents\/claimants have appeared through their<\/p>\n
\u00e9\/at<\/p>\n
learned counsel. I have heard the learned counsel on
\nboth sides and perused the records.\n<\/p>\n
6) As noticed above, in its judgment f\u00a5dated<\/p>\n
01.12.2004 while considering Point No.1, <\/p>\n
recorded a de\ufb01nite finding that the    <\/p>\n
travelling in the lorry in question  <\/p>\n
transporting any goods at that time.._ ln other” the  ><\/p>\n
\ufb01nding of the Tribunal was thatiatythe of accident,
\nthe deceased was V “trayellin.g  Aidan unauthorised
\npassenger in they goods”’\u00bbcarri’age_._ 2′ is no dispute<\/p>\n
that the —is a goods carriage VlZ., lorry<\/p>\n
bearing reg.istration’No- 232130. It is in the evidence<\/p>\n
 onyrecolrd that*th_e..,.deceased was a student and was<\/p>\n
  said lorry at the time of the accident to<\/p>\n
go   Therefore, the Tribunal held that the<\/p>\n
 deceased was an unauthorised passenger travelling in<\/p>\n
V~l,”_thel”goods carriage. In that View of the matter, the<\/p>\n
  Tribunal held that the insurer is not liable to indemnify<\/p>\n
 the insured. Consequently, the claim petition was<\/p>\n

\ndismissed against the Insurance Company. However,<\/p>\n
strangely the Tribunal reviewed its own judgment on the
\npetition filed by the ciaimants and directs the Insurance
\nCompany to pay the compensation amount  the
\nclaimants and then to recover the same
\nof the vehicle. it it<\/p>\n

jrcidgment, to the Court which passed the decree or<\/p>\n
drndade the order. However, such a review can be sought<\/p>\n
 "only if the party applying for review satisfies the Court<\/p>\n
that new and important matter or evidence has been<\/p>\n

\nafter exercise of due diligence as such, he could not
\nproduce the same before the Court when the decre:e*.was<\/p>\n

that there exists other sufficient reason for”-.reviewing<\/p>\n
the judgment or order. The -r__eview.of the   ;<\/p>\n

due    evidence was not within the
\nknowledge’ of nor it was their case that<\/p>\n
they could\u00e9unot’ produce any such evidence at the time<\/p>\n
 when :”the_”d.ecree was passed. It is neither the case of<\/p>\n
 the  that there was a mistake or error<\/p>\n
appare’n’t’oh the face of the record, which was required<\/p>\n
.   ‘tc-.__he ‘corrected by exercising the power of review. The
\njudgment of the Tribunal dismissing the ciaim petition<\/p>\n
  against Respondent No.2 was based on the definite<\/p>\n
\ufb01nding recorded by it on Point No.1 that the deceased<\/p>\n

\ntherefore, the insurer is not liable to indemnify the
\ninsured in respect of such claims. Having rega_rd._to<\/p>\n
such definite finding recorded by the  <\/p>\n
Tribunal in exercise of its power of revie’W’vu:nder. Order’*~ V<\/p>\n

9) It  gnovvowell\u00e9gsettiedllthat a policy of<\/p>\n
insurance’ issuefdg\u00e9iri,  of a goods carriage is not<\/p>\n
statutorily..required._Vto.:_lcover the risk of any passenger<\/p>\n
 ca,rri.ed_gi’inV% a good_s_..carriage for hire or reward, unless<\/p>\n
 i there “contract to the contrary. In the case on hand,<\/p>\n
th’e”j)olic3tfijssued was only an “Act Policy”. There was no<\/p>\n
 contract to the contrary by receiving additional<\/p>\n
 premium. Therefore, in the light of the finding on Point<\/p>\n
 “No.1, the Tribunal is not justified in reviewing its<\/p>\n
judgment and directing the appeilant\/Insurance<\/p>\n
