SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/07\/2009 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India<br \/>\nthe petitioner has prayed for an appropriate writ, order or direction<br \/>\ndirecting the respondents to appoint the petitioner on compassionate<br \/>\nground on the death of his father, who has died in the year 1983.\n<\/p>\n<p>2.\tIt<br \/>\nis not in dispute that the father of the petitioner died on<br \/>\n06\/01\/1983 and the petitioner after becoming major made the<br \/>\napplication for compassionate appointment on 06\/11\/1997.    It is the<br \/>\ncase on behalf of the petitioner that the said application of the<br \/>\npetitioner for compassionate appointment was rejected and, therefore,<br \/>\nthe petitioner has preferred the present Special Civil Application<br \/>\nunder Article 226 of the Constitution of India.\n<\/p>\n<p>3.\tIdentical<br \/>\nquestion came to be considered by this Court in Special Civil<br \/>\nApplication Nos. 1678\/1997 and 1903\/2005 and this Court has<br \/>\nrelied upon the decisions of the Hon&#8217;ble Supreme Court in the case of<br \/>\nSTATE OF J&amp; K ORS Vs. SAJAD AHMED MIR reported in (2006)<br \/>\n5 SCC 766 and in the case of NATIONAL HYDROELICTRIC POWER<br \/>\nCORPORATION AND ANR Vs. NANAK CHAND AND ANR reported in 2004<br \/>\nAIR SCW 6339 rejecting the applications, which were filed<br \/>\nbelatedly.\n<\/p>\n<p>4.\tIn<br \/>\nthe decision of NATIONAL HYDROELICTRIC POWER CORPORATION (Supra)<br \/>\nthe Hon&#8217;ble Supreme Court has observed that &#8230;&#8230; it is to be seen<br \/>\nthat the appointment on compassionate ground is not a source of<br \/>\nrecruitment, but merely an exception to the requirement regarding<br \/>\nappointments being made on open invitation of application on merits.<br \/>\nBasic intention is that on the death of the  employee concerned, his<br \/>\nfamily is not deprived of means of livelihood.  The object is to<br \/>\nenable the family to get over sudden financial crises .\n<\/p>\n<p>5.\tIn<br \/>\nthe decision of   SAJAD AHMED MIR (Supra) it is observed that<br \/>\nthe compassionate appointment is exception to the general rule and<br \/>\nnormally, an employment in the Government or other public sectors<br \/>\nshould be open to all eligible candidates who can come forward to<br \/>\napply and compete with each other. It is in consonance with Article<br \/>\n14 of the Constitution. On the basis of competitive merits, an<br \/>\nappointment should be made to public office. It is also further<br \/>\nobserved by the Hon&#8217;ble Supreme Court that this general rule should<br \/>\nnot be departed from except where compelling circumstances demand,<br \/>\nsuch as, death of the sole breadwinner and livelihood of the family<br \/>\nsuffering because of the setback. It is also further observed by the<br \/>\nHon&#8217;ble Supreme Court that once it is proved that inspite of the<br \/>\ndeath of the breadwinner, the family survived and substantial period<br \/>\nis over, there is no necessity to say  goodbye  to the normal<br \/>\nrule of appointment and to show favour to one at the cost of the<br \/>\ninterests of several others ignoring the mandate of Article 14. In<br \/>\nthe case before the Hon&#8217;ble Supreme Court, the learned Single Judge<br \/>\ndismissed the petition on the ground of delay and laches. The<br \/>\nDivision Bench set aside the said order and passed an order of<br \/>\nappointment on compassionate ground. The Hon&#8217;ble Supreme Court set<br \/>\naside the order passed by the Division Bench and has observed as<br \/>\nabove.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe decision of the Hon&#8217;ble Supreme Court in case of SAJAD AHMED<br \/>\nMIR (Supra) and the facts of the present case that more than 14<br \/>\nyears have been passed after the death of the deceased employee and<br \/>\nthe family is surviving for all these 14 years, as observed by the<br \/>\nHon&#8217;ble Supreme Court, there is no necessity to say  goodbye  to<br \/>\nthe normal rule of appointment and to show favour to petitioner at<br \/>\nthe cost of the interests of several others ignoring the mandate of<br \/>\nArticle 14. Even to direct the respondents to appoint the petitioner<br \/>\non compassionate ground today i.e. after a period of 14 years on the<br \/>\ndeath of the employee would be against the object and purpose of<br \/>\ncompassionate appointment.
