Bawa, Director (Plg),\n                            MPPR)\n\nDate of Hearing      :      19.12.2008\n\nDate of Decision :          19.12.2008\n\nFacts<\/pre>\n<p>       By his letter of 24.8.2007, the appellant had made the following<br \/>\nrequest to the CPIO :-\n<\/p>\n<p>       &#8220;Kindly refer to Ministry of Urban Development (Delhi Division),<br \/>\nGovernment of India&#8217;s Notification No. S.O. 1456(E) dated 7.9.2006<br \/>\nread with corrigendum No. S.O. 1511 (E) dated 14.9.2006 and furnish<br \/>\nthe following information under section 7 of the RTI Act, 2005 :-<br \/>\n   i.     Whether the Shops (except prohibited ones with non-\n<\/p>\n<blockquote><p>          permissible uses) functioning in residential plotted<br \/>\n          development and group housing on streets\/areas notified as<br \/>\n          commercial by the Government of NCT of Delhi in pursuance<br \/>\n          of the Government of India&#8217;s Notifications referred to above<br \/>\n          shall be treated as regularized and considered Local Shopping<br \/>\n          Centers after getting registered and payment of special<br \/>\n          Conversion charges fixed by the Central Government; and<br \/>\n   ii.    It is presumed that the shops referred to at (i) above on the<br \/>\n          commercialized streets\/areas shall be permitted to function for<br \/>\n          purpose of more flexible land use without unduly rigid<br \/>\n          restrictions regarding the floors from which they operate as<br \/>\n          recommended by Shri Tejinder Khanna Committee.&#8221;\n<\/p><\/blockquote>\n<p>2.    The CPIO by his letter dated 27.12.2007 had informed the<br \/>\nappellant, that the relevant information was covered under chapter 15.0<br \/>\n within &#8220;Mixed Use Regulation&#8221; in sub paras 15.4, 15.5, 15.9 &amp; 15.12 of<br \/>\nMPD-20201.\n<\/p>\n<p>3.     On appeal having been filed, the Appellate Authority vide letter<br \/>\ndated 19.2.2008 had asked the appellant to visit his office for any further<br \/>\nclarifications.\n<\/p>\n<p>4.   The present appeal has been filed against the order of the<br \/>\nAppellate Authority.\n<\/p>\n<p>5.     The matter was heard on 19.12.2008. The appellant did not<br \/>\nappear before the Commission. DDA is represented by officer<br \/>\nmentioned above. Smt Bawa would submit that in addition to the paras<br \/>\nmentioned by CPIO, another relevant para in this regard is 15.3 and that<br \/>\nall these paras contain the relevant information as requested for by the<br \/>\nappellant. She would also submit that some modifications have been<br \/>\nmade in MPD 2021 and that she would send a fresh reply to the<br \/>\nappellant intimating updated position to him.\n<\/p>\n<p>                                DECISION\n<\/p>\n<p>6.    In view of the above, Smt Bawa is directed to furnish requisite<br \/>\ninformation to the appellant in next 3 weeks time.\n<\/p>\n<p>7.
