\n  petitioner herein who is a<\/p>\n
businessman has and refused to maintain<\/p>\n
_ respo\ufb01nldent.  to  as such they \ufb01led C.Misc.322\/04<\/p>\n
  rnaihtenance at the rate of Rs.4.000\/~\u00bb p.m. to<\/p>\n
theatre~R\u00a2s\u00a7pornaie1it No.1 and Rs.2,ooo\/~ p.m. to<\/p>\n
g Reshfjondentlll No.2 and 3 and also sought for litigation<\/p>\n
V2 V’  of Rs.5,000\/~.\n<\/p>\n
3. The Court below has allowed the C.Misc.<\/p>\n
 No.322\/()4 awarding maintenance of Rs.3,000\/– p.m. t.o<\/p>\n
the 154″\u00bb respondent and Rs.1,500\/~ p.m. to respondent
\nNos.2 and 3 from the date of petition and Rs.2,00’O\/– for<\/p>\n
litigation expenses. Admittedly the said order is passed<\/p>\n
.L~\\<\/p>\n

on 16\/5\/2009 in (2. Misc. 322\/04 which yvas \ufb01led  the<\/p>\n
year 2004. It is also seen from the records that<\/p>\n
the pendency of the proceedings in the Court  V’<\/p>\n
maintenance was paid by the petitionerj It ‘eFase;<\/p>\n
of the respondents that since thet’date_iV_they’  <\/p>\n
separately from petitioner i1<2.s:T2'.O0OV' nothing  been V<\/p>\n
paid by him towards  <\/p>\n
4. The learned counsel  submits that
\nthough thepre,  below, the
\npetitioner–. ‘  certain amount to<\/p>\n
respondents; _  ready and willing to take care<\/p>\n
 \u00ab_ of re:,spondents’;’*–\u00bb .’i’__h_ey are comfortably staying with the<\/p>\n
 ‘p.31″entsV”~io’feV respondent in luxury house at<\/p>\n
 tf\ufb01angalore. The 18’, respondent has no<\/p>\n
 intere.stg_inV coming and staying with petitioner and to<\/p>\n
A “it ” discharge her matrimonial obiigation. Since she is<\/p>\n
  interested in luxury life, she is deliberately staying away<\/p>\n
from petitioner who is working as a coolie. It is also
\nsubmitted that he does not have sufficient income for
\nhis maintenance, hence he is not in a position to pay<\/p>\n
the naaintenance awarded by Family Court.

5. The learned counsel for respondent <\/p>\n
submits that petitioner herein is a  V’<\/p>\n
business under the trade nan1eg’D’ub3.i <\/p>\n
also made gains in real estate business in CaliCut~ anciis’ <\/p>\n
financially well placed in    S pay ll<\/p>\n
maintenance amount. Court Below.<\/p>\n<\/p>\n
6. This Court   counsel for
\nparties no\ufb01c\u00e9d  tliou  that there
\nis failure     stay with 111111 and
\nshe     house and she is<\/p>\n
con1fortah’iy  father, there is nothing on<\/p>\n
 f\u20acC0iZdlVto sl1ow”th.af:Wl1a,e has made attempt to file petition<\/p>\n
  of conjugal rights with the 15*’ respondent<\/p>\n
ar1d”7tov ljgthat respondents would come back to<\/p>\n
 niatrinionial house and stay with him.<\/p>\n
 V. ‘7. He has also not \ufb01led petition for divorce. This<\/p>\n
  would lead to presumption that petitioner is neither<\/p>\n
 interested to take back his wife nor to maintain them by<\/p>\n
providing \ufb01nancial support. On going through the
\nimpugned order of Court below it is seen that Court<\/p>\n
below has considered all these aspects and has awarded<\/p>\n

maintenance to respondent Nos. 1 to 3. This “of<\/p>\n
the opinion that there is neither  V’<\/p>\n
