Petitioner, Manoj Kumar, filed<br \/>\nCW. No.7245\/2001 in November, 2001, seeking a<br \/>\nprohibition on NDMC from carrying out demolition<br \/>\nwork at the Model Dhobi Ghat, Bapa Nagar, Dr. Zakir<br \/>\nHussain Marg, New Delhi. He also filed subsequently<br \/>\nCW. No. 1184\/2002, seeking a writ of mandamus to<br \/>\nthe NDMC to issue licenses for the Dhobi Ghat to<br \/>\nthe him and other persons, nominated by him.<br \/>\nPetitioner also sought a direction to NDMC to<br \/>\ncancel a license issued to Smt. Tara Devi, respondent<br \/>\nNo.4, and her nominees.\n<\/p>\n<p>2. In CW. No. 7245\/2001, petitioner had<br \/>\nclaimed that he had been carrying on the business<br \/>\nof laundry in the name and style of J &amp; K Dry-<br \/>\ncleaners at the Model Dhobi Ghat, Bapa Nagar for<br \/>\nover 8 years. He claimed that he had been carrying<br \/>\non the business since Dhobi Ghat was constructed<br \/>\nand he had a built a small jhuggi in the said Dhobi<br \/>\nGhat. Petitioner claimed that jhuggi was sought to<br \/>\nbe demolished without prior notice or any alternate<br \/>\nplace been allotted to the petitioner. An<br \/>\ninterim order, directing that the premises of the<br \/>\npetitioner be not demolished, was passed on<br \/>\n28.11.2001. Respondent\/NDMC on being served in the<br \/>\nwrit petition, claimed that demolition action had<br \/>\nbeen taken as far back as in March, 2001 and the<br \/>\npetitioner was attempting to build a jhuggi in the<br \/>\ngarb of interim protection granted by the Court.<br \/>\nThe interim order was modified on 29.5.2001 and<br \/>\nclarified to the extent that the same will not<br \/>\ncome in the way of the respondent taking acting<br \/>\nfor removal of any unauthorized structure, except<br \/>\nthe Dhobi Ghat.\n<\/p>\n<p>3. Pleadings were completed and counsel for<br \/>\nthe parties had been heard and judgment reserved on 16.8.2002.\n<\/p>\n<p>4. In CW. No. 1184\/2002, petitioner claimed<br \/>\nthat he was the duly elected Pradhan of the Bapa<br \/>\nNagar Model Dhobit Ghat in the election conducted<br \/>\non 2.9.2001. He, therefore, claimed that he was<br \/>\nentitled to the grant of  license and for nominating<br \/>\nthe other dhobis. Petitioner claimed that non-<br \/>\nrecognition of the election conducted under the<br \/>\nauspices of the Delhi Pradesh Dhobi Ghats Maha<br \/>\nSabha was illegal and was at the behest of the<br \/>\nvested interests. Petitioner claimed that the<br \/>\nstand of NDMC that respondent No.4, Tara Devi, was<br \/>\nthe elected Pradhan of Dhobi Ghat was wrong as<br \/>\nTara Devi&#8217;s election was through a political<br \/>\nperson, which is not recognised by the NDMC.<br \/>\nBesides, she was not eligible being a woman to be<br \/>\nthe President. In brief, he claimed that the<br \/>\ndenial of issuance of license and the threat to<br \/>\nforcible removal of the petitioner from the site<br \/>\nwas illegal.\n<\/p>\n<p>5. Ms. Geeta Luthra, appearing for the<br \/>\npetitioner, submitted that though the petitioner<br \/>\nwas duly elected in the election, but on account<br \/>\nof the clout of respondent No.4 with NDMC, name of<br \/>\nthe petitioner was not included in the list of<br \/>\nelected Pradhans of Dhobi Ghat, as issued by NDMC.<br \/>\nInstead of name of respondent No.4, Tara Devi was<br \/>\ngiven at S.No. 10.\n<\/p>\n<p>6. Learned counsel, Ms. Geeta Luthra,<br \/>\nfurther submitted that NDMC had acted in a discriminatory<br \/>\nmanner inasmuch as the petitioner&#8217;s<br \/>\njhuggi and structure at the Dhobi Ghat had been<br \/>\nremoved and assets taken away by the police, while<br \/>\nthe illegal structures of respondent No.4, Tara<br \/>\nDevi and her nominees were still there. Learned<br \/>\ncounsel submitted that the elections of the petitioner<br \/>\nhad been conducted by Prof. Chottey Lal,<br \/>\nwhose recommendations for other Pradhans had been<br \/>\naccepted except for the petitioner.\n<\/p>\n<p>7. Mr. Sandeep Sethi, learned counsel for<br \/>\nthe respondent No. 4, Tara Devi, opposing the writ<br \/>\npetition, submitted that the petitioner was never<br \/>\na licensed Dhobi. Petitioner at the relevant time<br \/>\nwas not a licensed Dhobi and as such the question<br \/>\nof petitioner getting elected as a Pradhan did not<br \/>\narise. He submitted that respondent No.4, Tara<br \/>\nDevi, had been elected in the election, which was<br \/>\n conducted on 25.6.2001 and was duly recognized by<br \/>\nNDMC. Learned counsel pointed out that once respondent No.4, Tara Devi, had been duly elected as<br \/>\nthe Pradhan of Bapa Nagar Dhobi Ghat on 25.6.2001<br \/>\nfor the year 2001-2002, there was no question of<br \/>\nthe petitioner being elected on 2.9.2001, as is<br \/>\nsought to be claimed on the basis of an un-signed<br \/>\nletter issued by Prof. Chottey Lal, filed by the<br \/>\npetitioner.\n<\/p>\n<p>8. Learned counsel also pointed out that<br \/>\nrespondent No.4 had filed a CW. No. 3271\/2001, which<br \/>\nwas withdrawn since NDMC had already removed the<br \/>\nunauthorised structure of the petitioner. The<br \/>\npresent writ petition is stated to have been filed<br \/>\nby way of counter blast by unauthorised occupants.<br \/>\nLearned counsel also pointed out that petitioner<br \/>\nhad earlier filed a suit for injunction against<br \/>\ndis-possession. The prayer for injunction in the<br \/>\nsuit had been dismissed. Petitioner has since then<br \/>\npreferred an appeal. Learned counsel further<br \/>\nsubmitted that an election, as is sought to be<br \/>\nraised by the petitioner relating to the officer<br \/>\nbearers of the association of Dhobis in respect of<br \/>\nDhobi Ghat, would not be a matter amendable to writ<br \/>\njurisdiction as no statutory rights are involved.\n<\/p>\n<p>9. Ms. Hima Kohli, learned counsel for the<br \/>\nrespondent\/NDMC, stated that a meeting had been<br \/>\norganized on 15.10.2001, by the Director General<br \/>\nWelfare of NDMC and attended by the Director<br \/>\n(Enforcement) and representatives of the different<br \/>\norganisations of Dhobi Samaj. In the said meeting,<br \/>\nit was decided that all the elections of Pradhan<br \/>\nmay be treated as suspended and representatives of<br \/>\nDhobi Samaj were requested to give suggestions to<br \/>\nframe a new policy in the NDMC area. As a result,<br \/>\nas on date, there is no recognised Pradhan of the<br \/>\nvarious Dhobi Ghat,s including Bapa Nagar Model<br \/>\nDhobi Ghat as the new policy is yet to be formulated.\n<\/p>\n<p>10. From the foregoing discussion, it would<br \/>\nbe seen, first of all, that the petitioner&#8217;s claim<br \/>\nto be the duly elected Pradhan of Bapa Nagar Dhobi<br \/>\nGhat is strongly controverter and disputed by<br \/>\nrespondent No.4, inasmuch as, while petitioner<br \/>\nclaims to have been elected in a meeting of<br \/>\n2.9.2001, respondent No.4, Tara Devi, was elected<br \/>\non 25.6.2001. Besides, the dispute as to who is<br \/>\nduly elected Pradhan of Dhobi Ghat does not involve<br \/>\ndetermination of any statutory rights and is<br \/>\nnot to be done in the exercise of writ jurisdiction.<br \/>\nPetitioner does not even possess, as of now,<br \/>\na license for the Dhobi Ghat. Even a licensed<br \/>\nDhobi only has a right to the use of Dhobi Ghat<br \/>\ni.e. of the Thada. It does not entitled any of the<br \/>\nDhobis is raise unauthorised construction or<br \/>\nstructure on Government lands. It was on account<br \/>\nof this that the ex parte restraint was modified<br \/>\nvide order dated 29.5.2002, confining it to Dhobi<br \/>\nGhat itself not being demolished. The grievance of<br \/>\nthe petitioner that unauthorised structure of<br \/>\nother are remaining cannot be entertained under<br \/>\nArticle 14 of the Constitution of India. Nevertheless, it may<br \/>\nbe noted that learned counsel for the<br \/>\nrespondent\/NDMC has stated that NDMC would and is<br \/>\ncommitted to removal all unauthorised construction<br \/>\nNothing further survives in view of this statement.\n<\/p>\n<p>The writ petitions have no merit and are<br \/>\ndismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Delhi High Court Manoj Kumar vs N.D.M.C.
