Learned counsel Mr.Hardik C.Rawal accepts and<br \/>\nwaives notice on behalf of the respondents. No separate notice be<br \/>\nissued on them. Counsel for the appellants will serve two copies of<br \/>\nthe paper-book on him by tomorrow. The Appeals may be disposed of at<br \/>\nthe stage of admission.\n<\/p>\n<p>\tPost<br \/>\nthese matters on 28th July 2011 along with Letters Patent<br \/>\nAppeals No.972, 994 to 998 and 1000 of 2011.\n<\/p>\n<p>\tCounsel<br \/>\nfor the appellants sought for interim relief in terms of the order<br \/>\ndated 1st July 2011 passed in Letters Patent Appeal No.972<br \/>\nof 2011.\n<\/p>\n<p>\tIn<br \/>\nreply, Mr.Rawal, learned counsel for the Gujarat State Road Transport<br \/>\nCorporation Limited, submits that the appellants have not paid<br \/>\nlicence fee to the Transport Corporation nor paid municipal tax to<br \/>\ntheir respective Municipal Corporations\/ Municipalities. As such<br \/>\nMunicipal Corporations will recover the amount from the<br \/>\nrespondent-Transport Corporation.\n<\/p>\n<p>\tHaving<br \/>\nheard the learned counsel for the parties, we pass the following<br \/>\ninterim order:\n<\/p>\n<p>\tDuring<br \/>\n the pendency of the Appeals,  if one or other licencee  deposits<br \/>\nlicence fee with the Transport Corporation for the period upto June<br \/>\n2011 and continues to pay such licence fee for the subsequent months<br \/>\nand produces receipts showing payment of municipal tax to their<br \/>\nrespective Municipal Corporations\/Municipalities for the period upto<br \/>\nJune 2011, in such case, licencee be allowed to run his sugar-cane<br \/>\nstall at the same place  where he was running.  But, they cannot<br \/>\npollute the area, the garbage should be lifted by them and they shall<br \/>\ndispose of the same in the municipal dust bins, and all through out<br \/>\nthey will not be putting any waste in the drainage.\n<\/p>\n<p>\tThe<br \/>\naforesaid order will be applicable to all cases, including the case<br \/>\nin which this Court has already passed interim orders allowing one or<br \/>\nother appellant to run their sugar-cane stall. It is also made clear<br \/>\nthat the interim order(s) passed by this Court will be applicable to<br \/>\nonly the licencee, who has been allowed to run such sugar-cane stall,<br \/>\nand not the power of attorney holder.\n<\/p>\n<p>\tIf<br \/>\none or other licencee is  not liable to pay municipal tax under the<br \/>\nlaw, he will have to  obtain a certificate to that effect from the<br \/>\nconcerned Municipal Corporation\/Municipality, and will submit the<br \/>\nsame before the Transport Corporation. In case of non-compliance of<br \/>\nthis order, such licencee will not be allowed to run the sugar-cane<br \/>\nstall.\n<\/p>\n<p>\tThe<br \/>\nTransport Corporation will forward a copy of this order to all the<br \/>\nconcerned Municipal Corporations\/Municipalities.\n<\/p>\n<p>\tAll<br \/>\nthe Civil Applications stand disposed of with the aforesaid<br \/>\nobservation.
