And Others\nPetitioner Counsel :- Jitendra Pandey\nRespondent Counsel :- C.S.C.\n\nHon'ble Dilip Gupta,J.\n<\/pre>\n<p>The sole relief claimed in the present petition is for a direction<br \/>\nupon the respondents to consider the application filed by the<br \/>\npetitioner-Institution for bringing it on the grant-in-aid list of the<br \/>\nState Government after ignoring condition imposed in paragraph<br \/>\n2(13) of the Government Order dated 7th September, 2006.\n<\/p>\n<p>It is stated by Sri Jitendra Pandey, learned counsel for the<br \/>\npetitioners that the only reason assigned for not bringing the<br \/>\npetitioner-Institution on the grant-in-aid list of the State<br \/>\nGovernment is because of the condition imposed in paragraph<br \/>\n2(13) of the Government Order dated 7th September, 2006. He has<br \/>\nsubmitted that the condition imposed under paragraph 2(13) of the<br \/>\naforesaid Government Order dated 7th September, 2006 has been<br \/>\nset aside by this Court in Committee of Management, Mata<br \/>\nTapeshwari Saraswati Vidya Mandir Uchchattar Madhyamik<br \/>\nVidyalaya, Ghazipur &amp; Ors. Vs. State of U.P. Ors, 2007 (1)<br \/>\nADJ 443 and that the Special Appeal filed against the said<br \/>\njudgment and order has also been dismissed and that the Supreme<br \/>\nCourt in Special Leave Petition (C) No.4630 of 2008 (State of U.P.<br \/>\n&amp; Ors. Vs. Committee of Management, Mata Tapeshwari<br \/>\nSaraswati Vidya Mandir &amp; Ors.) has also upheld the orders of this<br \/>\nCourt setting aside the said condition.\n<\/p>\n<p>The Supreme Court, in the aforesaid Special Leave Petition (C)<br \/>\nNo.4630 of 2008, has observed as follows:-\n<\/p>\n<p>&#8220;These Special Leave Petitions are, accordingly, dismissed. As directed by the<br \/>\nlearned Single Judge of the High Court by his judgment and order dated 4th<br \/>\nJanuary, 2007, and upheld by the Division Bench by its judgment and order<br \/>\ndated 15th January, 2008, the petitioners are directed to consider the case of<br \/>\nthe Respondent institutions, along with other applicants, for being brought<br \/>\nwithin the ambit of the grant-in- aid Scheme in pursuance of the Government<br \/>\nOrder dated 7th September, 2006, and while doing so ignore Condition<br \/>\nNo.2(13) of the said Order and Condition No.12 of the Advertisement dated<br \/>\n9th September, 2006, issued by the Directorate of Basic Education, U.P.&#8221;<br \/>\n Learned Standing Counsel for the respondents has not disputed<br \/>\nthis position.\n<\/p>\n<p>In view of the aforesaid, this petition is disposed of with a<br \/>\ndirection to the respondents to consider the case of the petitioner-<br \/>\nInstitution for bringing it on the grant-in-aid list of the State<br \/>\nGovernment pursuant to the Government Order dated 7th<br \/>\nSeptember, 2006 after ignoring condition imposed under<br \/>\nparagraph 2(13) of the aforesaid Government Order.\n<\/p>\n<p>Order Date :- 23.7.2010<br \/>\nSK\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Dwaba Shiksha &#8230; vs State Of U.P.
