BASANT, J.\n\n\n             ````````````````````````````````````````````````````\n\n                      B.A. No. 301 OF 2008 A\n\n             ````````````````````````````````````````````````````\n\n            Dated this the 23rd day of January, 2008\n\n\n                               O R D E R\n<\/pre>\n<p>             Petitioner   is   the   6th  accused   and   he   faces<\/p>\n<p>indictment in a prosecution for offences punishable, inter alia,<\/p>\n<p>under   Sections   308   and   326   read   with   149   IPC.     The<\/p>\n<p>petitioner   was released  at   the  crime  stage   but  after  the   final<\/p>\n<p>report   was   filed,   he   could   not   enter   appearance   as   he   was<\/p>\n<p>abroad in connection with his employment.  The case against<\/p>\n<p>the petitioner has been split up and the same is transferred to<\/p>\n<p>the list of long pending cases.  Coercive processes have been<\/p>\n<p>issued   against   the   petitioner   by   the   learned   Magistrate     to<\/p>\n<p>procure   his   presence.     The   petitioner   finds   such   processes<\/p>\n<p>chasing him now.\n<\/p>\n<\/p>\n<p>      2.     The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is absolutely innocent.   His absence earlier was<\/p>\n<p>not wilful or deliberate.    The petitioner is willing to surrender<\/p>\n<p>BA.301\/08<\/p>\n<p><span class=\"hidden_text\">                                    : 2 :<\/span><\/p>\n<p>before the learned  Magistrate  and seek regular bail.   But he<\/p>\n<p>apprehends   that   his   application   for   bail   may   not   be<\/p>\n<p>considered   by   the   learned   Magistrate   on   merits,   in<\/p>\n<p>accordance with law and expeditiously.     He, therefore, prays<\/p>\n<p>that directions under Section 438 and\/or 482 Cr.P.C. may be<\/p>\n<p>issued   to  the  learned   Magistrate   to  release   the   petitioner  on<\/p>\n<p>bail when he appears and applies for bail.<\/p>\n<p>         3.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate   and   explain   to   the   learned   Magistrate,   the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate. I find absolutely no reason to assume<\/p>\n<p>that the learned Magistrate would not consider the application<\/p>\n<p>for bail to be filed  by the  petitioner on merits,  in accordance<\/p>\n<p>with   law   and   expeditiously.     Every   court   must   do   the   same.<\/p>\n<p>No   special   or   specific   directions   appear   to   be   necessary.<\/p>\n<p>Sufficient   general   directions   have   been   issued   in  Alice<\/p>\n<p>George Vs. Deputy Superintendent of Police [2003 (1) KLT<\/p>\n<p>339].\n<\/p>\n<p>\nBA.301\/08<\/p>\n<p><span class=\"hidden_text\">                                    : 3 :<\/span><\/p>\n<p>       4.
