The name of the applicant is not mentioned<br \/>\nin the FIR. The stock of liquor has not been seized from the<br \/>\napplicant and the applicant was not aware that who had fetched said<br \/>\nstock of liquor, from where and for what purpose. Therefore, the<br \/>\napplicant may kindly be released on bail by imposing suitable<br \/>\nconditions.\n<\/p>\n<p>3.\tLearned<br \/>\nAPP Mr. Pandya for the State submitted that considering the<br \/>\nseriousness of the offence, in which the applicant is involved, the<br \/>\napplication of the applicant is required to be rejected.\n<\/p>\n<p>4.<br \/>\nHaving considered the rival submissions and on perusal of the role<br \/>\nattributed to the applicant as reflected in the FIR, police papers,<br \/>\nprovisions of Sections  of the IPC and quantum of punishment and the<br \/>\nfact that there is no direct allegation against the applicant, I am<br \/>\nof the view that the applicant deserves to be enlarged on bail. This<br \/>\ncourt is not entering into the detail discussion of the evidence at<br \/>\nthis stage of bail.\n<\/p>\n<p>5.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith CR No. I-281 of 2010 registered at Dahegam Police Station, on<br \/>\nexecuting a bond of Rs.10,000\/- [Rupees ten thousand only] with one<br \/>\nsurety of the like amount to the satisfaction of the Trial Court and<br \/>\nsubject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\nhis presence at concerned Police Station on 15th day of<br \/>\nevery English calendar month at 11.00 AM till the trial is over;\n<\/p>\n<p>[g]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[h]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>6.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>7.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>8.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute to the aforesaid extent.\tDirect Service is<br \/>\npermitted.\n<\/p>\n<p>(Z.K.SAIYED,J.)<\/p>\n<p>ynvyas<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Bhagwan vs State on 4 October, 2011 Author: Z.K.Saiyed, Gujarat High Court Case Information System Print CR.MA\/13787\/2011 3\/ 3 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD CRIMINAL MISC.APPLICATION No. 13787 of 2011 ====================================== BHAGWAN @BHERU LALCHAND TEKWANI &#8211;
