                  by the white ants and it was reconstructed when a notice with<\/p>\n
                  regard to the same was given to the counsel who provided the<\/p>\n
                  court with the copy of the petition for consideration.<\/p>\n
                           Heard learned counsel appearing for the applicants as<\/p>\n
                  well as learned counsel appearing for the Opposite Party No. 2.<\/p>\n
                           This petition has been preferred under section-482 of<\/p>\n
                  the Cr.P.C. against the order dated 23.09.2007 passed by Sri<\/p>\n
                  D. Srivastava, J.M. Ist Class, Gaya in Complaint Case No. 971<\/p>\n
                  of 2008 whereby and whereunder, he, having found prima facie<\/p>\n
                  case under section-498A of the of the Indian Penal Code,<\/p>\n
                  ordered to issue processes against the applicants and other<\/p>\n
                  accused to procure their attendance for facing trial for the<\/p>\n
                  above-said offence. The applicants have invoked the inherent<\/p>\n
                  jurisdiction of this court for quashing the above-said order dated
\n                     -2-<\/span><\/p>\n
23.09.2007.\n<\/p>\n
         Brief facts of the case are as follows:\n<\/p>\n
          O.P. No. 2 filed complaint case bearing Complaint<\/p>\n
Case No. 971 of 2008 against the applicants and two other<\/p>\n
accused stating therein that the marriage of opposite party No.<\/p>\n
2 was solemnized with accused Ajay Prasad @ Krishna Prasad<\/p>\n
in the year, 1992 according to Hindu Rites and Rituals and after<\/p>\n
marriage, opposite party No. 2 went to her matrimonial home<\/p>\n
and started leading her conjugal life alongwith her husband and<\/p>\n
after sometimes, she gave birth to a male child. Subsequently,<\/p>\n
her husband developed illicit relationship with applicant No. 2<\/p>\n
who happens to be sister-in-law (Gotani) of the opposite party<\/p>\n
No. 2 and when she made protest, the applicants and other<\/p>\n
accused subjected her to cruelty and harassment in both ways;<\/p>\n
mentally and physically and also started demanding Rs 25,000\/-<\/p>\n
for starting a business. Furthermore, when the father of<\/p>\n
opposite party No. 2 visited house of the applicants, the same<\/p>\n
demand was made by the applicants and other accused and<\/p>\n
also they (applicants) misbehaved with him. The father of the<\/p>\n
opposite party No. 2 filed an Informatory Petition in the court of<\/p>\n
SDM, Gaya and when the applicants and other accused got<\/p>\n
knowledge about the filing of aforesaid informatory petition, they<\/p>\n
ousted the opposite party No. 2 from her matrimonial home and<\/p>\n
after that, the opposite party No. 2 filed the above-said case. It<\/p>\n
is also the case of opposite party No. 2 that applicant No. 1 was
\n                      -3-<\/span><\/p>\n
residing at Kolkata in connection with his business and he<\/p>\n
oftenly used to visit his house.\n<\/p>\n
         Learned court below having conducted an inquiry<\/p>\n
under section 202 of the Cr.P.C. passed the impugned order in<\/p>\n
the manner as stated above.\n<\/p>\n
         The contention of learned counsel for the applicants is<\/p>\n
that applicant Nos. 1, 2 and 3 are; brother-in-law, sister-in-law<\/p>\n
and mother-in-law of the complainant respectively and as a<\/p>\n
matter of fact, entire allegation centres around against the<\/p>\n
husband of opposite party No. 2 because according to<\/p>\n
complainant’s case itself, the alleged occurrence took place on<\/p>\n
account of so-called illicit relationship of the husband with the<\/p>\n
applicant No. 2. It is further contended on behalf of the<\/p>\n
applicants that the present case does not come under the<\/p>\n
purview of section-498A of the Indian Penal Code because<\/p>\n
now-a-days, it has become a fashion to implicate almost all the<\/p>\n
in-laws even if a trivial dispute took place between the husband<\/p>\n
and the wife.\n<\/p>\n
         Learned counsel for the applicants heavily relied upon<\/p>\n
a decision reported in 2010 (7) SCC 667 (Preeti Gupta & Anr.<\/p>\n
Vs State of Jharkhand & Anr) in which the Apex court of this<\/p>\n
country has held that,<\/p>\n
      “if there is no specific allegation made against the
\n      appellants in complaint, and         none of the
\n      witnesses attributing any role to them-Held, their
\n      implication was only meant to harass and
\n                       -4-<\/span><\/p>\n
      humiliate husband’s relatives”.\n<\/p>\n
          The learned counsel for the applicants also relied<\/p>\n
upon decision reported in 2009(10) SCC 184 (Neelu Chopra &<\/p>\n
Anr Vs Bharti) in which it has been held by the Apex Court of<\/p>\n
this country that ;\n<\/p>\n
      “…..for lodging a proper complaint mere mentioning
\n      of relevant sections and language of 498A and
\n      others are not sufficient…….”\n<\/p><\/blockquote>\n
          On the otherhand, learned counsel appearing for<\/p>\n
opposite party No. 2 supported the impugned order and<\/p>\n
submitted that learned court below has rightly held that a prima<\/p>\n
facie case is made out against the applicants. It is further<\/p>\n
contended by him that if the applicants have any grievance in<\/p>\n
respect of taking cognizance of the offence under section-498A<\/p>\n
of the Indian Penal Code, they may raise the aforesaid<\/p>\n
grievance at the time of framing of charge.<\/p><\/blockquote>\n
          Having heard rival contentions of the parties, I have<\/p>\n
gone through the record. It is well-known fact that section-498A<\/p>\n
of the Indian Penal Code has been enacted to check the dowry<\/p>\n
related offence. In the present case, the dispute between the<\/p>\n
husband and the wife arose on account of so-called illicit<\/p>\n
relationship of husband of the opposite party No. 2. So even if<\/p>\n
the contents of complaint are taken into consideration, then also<\/p>\n
it cannot be said that the dispute between the opposite party<\/p>\n
No. 2 and her husband arose on account of non-fulfillment of<\/p>\n
illegal demand. Furthermore, I find that according to complaint
\n                                -5-<\/span><\/p>\n
        case itself, the applicant No. 1 was residing at Kolkata and at<\/p>\n
        the time of alleged occurrence, he often used to come at his<\/p>\n
        home and apart from this, no specific overt act has been<\/p>\n
        attributed against these applicants.\n<\/p>\n
                 In the aforesaid circumstance, I am of the view that it<\/p>\n
        is a fit case in which this court must exercise the power vested<\/p>\n
        under it under section-482 of the Cr.P.C. to check the abuse of<\/p>\n
        the process of law.\n<\/p>\n
                 On the basis of aforesaid discussions, this Cr. Misc.<\/p>\n
        Case is allowed and the order dated 23.09.2007 passed by<\/p>\n
        Shri D. Srivastava, J.M. Ist Class , Gaya in connection with<\/p>\n
        Complaint Case No. 971 of 2008 stands quashed in respect of<\/p>\n
        the applicants only.\n<\/p>\n
