Aggarwal, J.<\/p>\n<p>1. Vide order dated 28.4.2006 passed by this Court in C.R. No. 2353 of 2006, petition was allowed and order dated 25.3.2006 passed by the Rent Controller was set aside and the petitioner was allowed one opportunity to produce one Dheeraj Kumar, Civil Engineer as witness subject to payment of Rs. 2,000\/-as costs.\n<\/p>\n<p>2. Thereafter, trial Court had fixed the date for 21.7.2006. On that day, request was made that Dheeraj Kumar and connived with the other party and Vikas Chopra be examined in his place. That request was not allowed by the trial Court on the ground that this Court had allowed only Dheeraj Kumar to be examined.\n<\/p>\n<p>3. Counsel for the petitioner points out that the report of this Vikas Chopra had been filed and only one opportunity is required to produce this Vikas Chopra and that payment of costs had already been made.\n<\/p>\n<p>4. After hearing counsel for the petitioner, this petition is allowed. It is directed that the trial Court shall allow Vikas Chopra to be examined in place of Dheeraj Kumar.
