Justice K.T.SANKARAN\n\n Dated :09\/02\/2010\n\n O R D E R\n                         K.T.SANKARAN, J.\n            ------------------------------------------------------\n                      B.A. NO. 409 OF 2010\n            ------------------------------------------------------\n            Dated this the 9th day of February, 2010\n\n                               O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure. Petitioners are accused Nos.1 and<\/p>\n<p>3   in Crime No.618 of 2009          of Sakthikulangara Police Station,<\/p>\n<p>Kollam District.\n<\/p>\n<\/p>\n<p>      2.  The offences alleged against the petitioners are under<\/p>\n<p>Sections 143, 147, 148, 323, 324, 447 and 326 read with Section<\/p>\n<p>149 of the Indian Penal Code.\n<\/p>\n<\/p>\n<p>      3. The prosecution case is that on 13.12.2009 at 6 PM, the<\/p>\n<p>accused persons forcibly entered into the house of the de facto<\/p>\n<p>complainant and attacked the de facto complainant and her<\/p>\n<p>husband. It is stated that the de facto complainant and her husband<\/p>\n<p>were attacked on account of the fact that the de facto complainant<\/p>\n<p>married a person belonging to another community. It is stated that<\/p>\n<p>the accused persons are the relatives of the de facto complainant.<\/p>\n<p>The overt act alleged against the first petitioner (first accused) is that<\/p>\n<p>he had beaten the husband of the de facto complainant with hands.<\/p>\n<p>However, the overt act alleged against the second petitioner (third<\/p>\n<p>B.A. NO. 409 OF 2010<\/p>\n<p>                                       :: 2 ::\n<\/p>\n<p>accused) is that he hit on the face of the de facto complainant with a<\/p>\n<p>brick and thereby she lost one tooth.\n<\/p>\n<\/p>\n<p>        4. Taking into account the facts and circumstances of the<\/p>\n<p>case, I am of the view that anticipatory bail can not be granted in<\/p>\n<p>favour of the second petitioner (third accused). If anticipatory bail is<\/p>\n<p>granted to the second petitioner, it would adversely affect the proper<\/p>\n<p>investigation of the case. More over, from the facts narrated above,<\/p>\n<p>it is clear that the second petitioner (third accused) is not entitled to<\/p>\n<p>the discretionary relief under Section 438 of the Code of Criminal<\/p>\n<p>Procedure, he having attacked a lady aged 25, resulting in the loss<\/p>\n<p>of her tooth.\n<\/p>\n<\/p>\n<p>        5.  However, the case of the first petitioner (first accused)<\/p>\n<p>stands on a different footing. The overt act alleged against him does<\/p>\n<p>not relate to any of the serious injuries caused either on the de facto<\/p>\n<p>complainant or on her husband. Therefore, I am inclined to grant<\/p>\n<p>anticipatory bail to the first petitioner (first accused).<\/p>\n<p>        6. There will be a direction that in the event of the arrest of the<\/p>\n<p>first petitioner (first accused), the officer in charge of the police<\/p>\n<p>B.A. NO. 409 OF 2010<\/p>\n<p>                                     :: 3 ::\n<\/p>\n<p>station shall release him on bail on his executing bond for<\/p>\n<p>Rs.15,000\/- with two solvent sureties for the like amount to the<\/p>\n<p>satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<blockquote><p>      a)    The first petitioner (first accused) shall report before the<br \/>\n            investigating officer between 9 A.M.      and 11 A.M. on<br \/>\n            alternate Mondays, till the final report is filed or until<br \/>\n            further orders;\n<\/p><\/blockquote>\n<blockquote><p>      b)    The first petitioner (first accused) shall appear before<br \/>\n            the investigating officer for interrogation as and when<br \/>\n            required;\n<\/p><\/blockquote>\n<blockquote><p>      c)    The first petitioner (first accused) shall not try to<br \/>\n            influence the prosecution witnesses or tamper with the<br \/>\n            evidence;\n<\/p><\/blockquote>\n<blockquote><p>      d)    The first petitioner (first accused) shall not commit any<br \/>\n            offence or indulge in any prejudicial activity while on<br \/>\n            bail;\n<\/p><\/blockquote>\n<blockquote><p>      e)    In case of breach of any of the conditions mentioned<br \/>\n            above, the bail shall be liable to be cancelled.<\/p><\/blockquote>\n<p>      The Bail Application is dismissed in so far as it relates to the<\/p>\n<p>second petitioner (third accused) and it is allowed in the manner<\/p>\n<p>indicated above, in so far as it relates to the first petitioner (first<\/p>\n<p>accused).\n<\/p>\n<\/p>\n<p>                                                  (K.T.SANKARAN)<br \/>\n                                                           Judge<br \/>\nahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Manoj vs State Of Kerala Represented By The on 9 February, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 409 of 2010() 1.
