Advocate\n\nHon'ble Imtiyaz Murtaza,J.\n<\/pre>\n<p>Hon&#8217;ble Naheed Ara Moonis,J.\n<\/p>\n<p>Heard learned counsel for the petitioners and also learned Additional<br \/>\nGovernment Advocate.\n<\/p>\n<p>The argument substantially is that fraught relation emanating from<br \/>\nmatrimonial bickering escalated into launching of criminal proceeding<br \/>\nvide F.I.R. which was registered at Case Crime No.407 of 2010, under<br \/>\nSections 498-A, 323 I.P.C. and Section 3\/4 Dowry Prohibition Act, P.S.<br \/>\nBhopa, District Muzaffar Nagar.\n<\/p>\n<p>Having considered the arguments advanced across the bar, we have a<br \/>\nfeeling that Court owes a duty to the society to strain to the utmost to<br \/>\nrepair the frayed relations between the parties so that the wounded<br \/>\nsituation may be healed into a healthy rapprochement. The matter in<br \/>\nhand also appears to be one of those cases in which reconciliation<br \/>\nshould be tried between the disputing parties.<br \/>\nWhile referring the matter to Mediation Centre with the consent of the<br \/>\npetitioners, it is directed that the petitioners shall deposit a sum of<br \/>\nRs.10,000\/- with the Mediation Centre by way of Bank draft drawn in<br \/>\nfavour of Mediation Centre, High Court, Allahabad, out of which a sum<br \/>\nof Rs.8000\/- shall be payable to the respondent no.4, victim and the<br \/>\nremaining amount shall be kept for being utilised by the Mediation<br \/>\nCentre. The amount aforesaid, it is further directed, shall be paid over<br \/>\nto the respondent no.4 on her appearing before the Mediation Centre<br \/>\non the date fixed. The amount aforesaid, it may be clarified, are meant<br \/>\nto meet expenses to be incurred for attending mediation sessions at<br \/>\nAllahabad for the respondent no.4 and the person escorting her.<br \/>\nThe office upon deposit of the Bank draft shall issue notice within one<br \/>\nweek to the respondent no.4, i.e the wife calling upon her to appear in<br \/>\nthe Mediation Centre at Allahabad High Court on a date to be<br \/>\n indicated in the said notice stating therein that the Bank draft<br \/>\ndeposited by the petitioners shall be delivered in the Mediation Centre<br \/>\non the date fixed. The said notice shall be served upon respondent<br \/>\nno.4 through C.J.M concerned. It needs hardly be said that both the<br \/>\nparties shall appear either on the date fixed or on a future date as may<br \/>\nbe agreed before the Mediation Centre for reconciliation.<br \/>\nThe Centre shall submit a report within one month from the date of<br \/>\nparties appearing before it for reconciliation. The case shall be listed in<br \/>\nthe fourth week of September, 2010 along with report of Mediation<br \/>\nCentre.\n<\/p>\n<p>In the meanwhile, the arrest of the petitioners in the aforesaid case<br \/>\nshall remain stayed.\n<\/p>\n<p>It may be made clear that in case, there occurs default by the<br \/>\npetitioners either in depositing the amount or in appearing before the<br \/>\nMediation Centre on the date or dates fixed, the interim order staying<br \/>\narrest shall cease to be operative and the Mediation Centre shall<br \/>\nimmediately communicate with the office which in turn shall list the<br \/>\ncase within a week before the Bench concerned for passing<br \/>\nappropriate order in the matter.\n<\/p>\n<p>It may be clarified that the case will not be treated as tied up to this<br \/>\nBench shall be listed before the appropriate Bench.<br \/>\nCopy of this order will not be issued unless steps are taken.<br \/>\nOrder Date :- 26.7.2010<br \/>\nMustaqeem.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Rakesh Kumar &amp; Others vs State Of U.P. &amp; Others on 26 July, 2010 Court No. &#8211; 42 Case :- CRIMINAL MISC.
