NO. 32257 OF 2007\n                             ---------------------\n             Dated this the 12thday of November, 2007\n\n                            J U D G M E N T\n<\/pre>\n<p>       The prayer in this writ petition is to direct the respondents to<\/p>\n<p>release the lorry bearing Reg. No.KL-16 B-1341 with the sand to the<\/p>\n<p>petitioner. The vehicle was seized on 17.9.07 on being intercepted<\/p>\n<p>by the 4th respondent holding that the sand transported was not<\/p>\n<p>having a valid permit. Though the petitioner submits that when the<\/p>\n<p>vehicle was intercepted the load was accompanied by Ext.P2 &#8216;P&#8217;<\/p>\n<p>form, that is disputed by the respondents. Respondents also make<\/p>\n<p>reference to a statement made by the petitioner on 18.10.07 wherein<\/p>\n<p>the petitioner himself had admitted that at the time of incident there<\/p>\n<p>was no pass accompanying the load. Irrespective of the controversy<\/p>\n<p>that are raised, I am not inclined to pass an unconditional order for<\/p>\n<p>release of the vehicle, as sought for by the petitioner. Therefore, if<\/p>\n<p>the petitioner wants release of the vehicle pending adjudication, he<\/p>\n<p>shall furnish a bank guarantee for the value of the vehicle to the<\/p>\n<p>satisfaction of the 1st respondent. This suggestion made by the court<\/p>\n<p>has been accepted by the petitioner.\n<\/p>\n<p>WPC NO 32257\/07                 Page numbers<\/p>\n<p>       Therefore, I direct the 1st respondent to fix the value of the<\/p>\n<p>truck within 7 days from the date of receipt of a copy of this<\/p>\n<p>judgment.
