OF GUJARAT &amp; 1 -\nOpponent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nBM MANGUKIYA for\nApplicant(s) : 1,MS BELA A PRAJAPATI for Applicant(s) : 1, \nMS\nMANISHA NARSINGHANI, AGP for Opponent(s) : 1, \nNone for Opponent(s)\n: 2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAVI R.TRIPATHI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/12\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tHeard learned Advocate<br \/>\nMr.Mangukiya for the applicant.\n<\/p>\n<p>2.\tRULE.\n<\/p>\n<p>3.\tThe prayer made in<br \/>\nthis application is as under:-\n<\/p>\n<p>&#8220;12.\ta.\tBe pleased<br \/>\nto recall the order passed by this Hon&#8217;ble Court dated April 1, 2010<br \/>\nin Misc.Civil Application no.3101 of 2009 in Special Civil<br \/>\nApplication no.2927 of 2004 and restore the matter on file;&#8221;\n<\/p>\n<p>3.1\tAnnexure-A to this<br \/>\napplication is the judgment and order passed by this Court (Coram:<br \/>\nHon&#8217;ble Mr.Justice D.A.Mehta, as he then was) in Special Civil<br \/>\nApplication No.2927 of 2004 dated 12.08.2009.  Annexure-B is the<br \/>\norder passed in Misc.Civil Application No.3101 of 2009 dated<br \/>\n29.01.2010, which reads as under:-\n<\/p>\n<p>&#8220;The matter has<br \/>\nbeen called out thrice.  Learned Advocate for the applicant is absent<br \/>\nat all the three calls.  Hence rejected for want of prosecution.&#8221;\n<\/p>\n<p>4.\tLearned Advocate for<br \/>\nthe applicant invited attention of the Court to the averments made in<br \/>\npara-9 of the application, which reads as under:-\n<\/p>\n<p>&#8220;9.\tThe applicant<br \/>\nsubmits that advocate of the petitioner-applicant was under the<br \/>\nimpression that the matter was listed before this Hon&#8217;ble Court at<br \/>\n5.00 PM and not at 4.00 PM.  It was a wrong impression on the part of<br \/>\nthe advocate of the applicant; in the Board, it was correctly<br \/>\nmentioned and recorded that the matter was listed at 4.00 PM.  But,<br \/>\ndue to the bonafide mistake of the advocate of the applicant, the<br \/>\nadvocate was under the impression that the matter would be called at<br \/>\n5.00 PM since this Hon&#8217;ble Court was sitting in the Division Bench.<br \/>\nHowever, at the time when the aforesaid matter was called out before<br \/>\nthis Hon&#8217;ble Court at 4.00 PM on that day, the advocate of the<br \/>\napplicant was actually arguing before another Hon&#8217;ble Court and<br \/>\ntherefore, advocate of the applicant-petitioner could not remain<br \/>\npresent before this Hon&#8217;ble court at the time when the matter was<br \/>\ncalled out and therefore, said matter is again dismissed for<br \/>\ndefault.&#8221;\n<\/p>\n<p>5.\tIn view of the<br \/>\naverments made in para-9 above, the application is allowed.  Rule is<br \/>\nmade absolute.
