\tIn
\nthe facts and circumstances of the case and by consent of both the
\nsides, this matter is taken up for hearing today.\n<\/p>\n
2.\tThis
\nis an application for anticipatory bail under Section 438 of the Code
\nof Criminal Procedure in connection with the FIR bearing Prohibition
\nC.R. No.5009 of 2011 registered with Vaav Police Station, Dist.
\nBanaskantha for the offences punishable under Sections 66-B, 65A,E,
\n81, 83, 98 and 116(B) of the Bombay Prohibition Act.\n<\/p>\n
3.\tLearned
\nadvocate Mr. Sharma for the applicant submitted that the applicant is
\nan innocent person and he has been wrongly arraigned in the case of
\nthe prosecution. He also submitted that the liquor is not belonged to
\nthe applicant and the vehicles, which were allegedly used for
\ncarrying the liquor, do not belong to the applicant. From the papers
\nof charge-sheet and FIR, there is no role attributed to the
\napplicant. The applicant is young person. Therefore, the applicant
\nmay kindly be granted anticipatory bail by imposing suitable
\nconditions.\n<\/p>\n
4.\tMr.\n<\/p>\n
Pandya, learned Additional Public Prosecutor representing the State
\nsubmitted that from the bare reading of the complaint, prima facie,
\nit appears that the role is attributed on the part of the applicant.
\nConsidering the nature of offences in which the applicant is involved
\nas well as the manner in which the offences are committed by the
\napplicant, the application deserves to be rejected.\n<\/p>\n
5.\tPerused
\nthe application along with papers and considered the submissions
\nadvanced by the learned advocate of respective parties. From the
\npapers, prima facie, it appears that there is no direct evidence
\nlinks the applicant in the commission of the offence and even at this
\nstage of anticipatory bail, this Court is not entering into merit of
\nthe case.\n<\/p>\n
6.\tIn
\nview of the above facts and circumstances of the case, I am inclined
\nto exercise discretion in favour of the applicant.\n<\/p>\n
7.\tThe
\napplication is stands allowed. The applicant is granted anticipatory
\nbail in the event of his arrest in connection with Prohibition CR
\nNo.5009 of 2011 registered with Vaav Police Station, Dist.
\nBanaskantha for the offences as alleged in FIR on his executing  bond
\nof Rs.10,000\/- [Rupees Ten thousand only] with one surety of the like
\namount on the following conditions that he shall:\n<\/p>\n
[a]\tco-operate
\nwith the investigation and make himself available for interrogation
\nwhenever and wherever he required.\n<\/p>\n
[b]\tshall
\nremain present at the concerned Police Station on 5.10.2011
\nat 11.00 AM<\/p>\n
[c]\tshall
\nnot hamper the investigation in any manner nor shall directly or
\nindirectly make any inducement, threat or promise to any person
\nacquainted with the facts of the case so as to dissuade him from
\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n
[d]\tat
\nthe time of execution of bond, furnish him residential address to the
\ninvestigating officer and the Court concerned and shall not change
\nthe residence till the final disposal of the case or till further
\norders;\n<\/p>\n
[e]\tnot
\nleave India without the permission of the Court and, if holding a
\npassport, he shall surrender the same before the Trial Court within a
\nweek;\n<\/p>\n
[f]\tnot
\nobstruct or hamper the police investigation and not play mischief
\nwith the evidence collected or yet to be collected by the police;\n<\/p>\n
8.\tIt
\nwould be open to the Investigating Officer to file an application for
\nremand if he considers it proper and just; and the competent Court
\nwould decide it on merits.\n<\/p>\n
9.\tIt
\nwould be open for the Investigating Agency to apply to the competent
\nMagistrate for police remand of the applicant. The applicant shall
\nremain present before the learned Magistrate on the first date of
\nhearing on such application and on all subsequent occasion, as may be
\ndirected by the learned Magistrate. This would be sufficient to treat
\nthe accused in the judicial custody for the purpose of entertaining
\napplication of the prosecution for police remand. This is, however,
\nwithout prejudice to the rights of the accused to seek stay against
\nan order of remand, if ultimately granted, and the power of the
\nlearned Magistrate to consider such a request in accordance with law.
\nIt is clarified that the applicant, even if remanded to the police
\ncustody upon completion of such period of police remand, shall be set
\nfree immediately, subject to other conditions of this anticipatory
\nbail order.\n<\/p>\n
10.\tAt
\nthe trial, the Trial Court shall not be influenced by the
\nobservations of preliminary nature, qua the evidence at this stage,
\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n
11.\tThe
\napplicant is permitted to obtain regular bail as per the established
\nprovision of law, within suitable time.\n<\/p>\n
\tRule
\nmade absolute. Direct service is permitted.\n<\/p>\n
