PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     I.A. is dismissed.\n<\/p>\n<p>     This special  leave petition  arises from the Order and<br \/>\njudgment of  the Division  Bench of the Allahabad High Court<br \/>\ndated July  3, 1996  made on  July 3,  1996 in Writ Petition<br \/>\nNo.6676(s\/s)\/92.\n<\/p>\n<p>     The petitioner was appointed on January 15, 1990 in the<br \/>\npay-scale   of\t  Rs.550-1100\/=\t  with\t  allowance;   total<br \/>\nremuneration  was  coming  to  Rs.1991.40.  He\twas  put  on<br \/>\nprobation as  contemplated under clause (2) of the letter of<br \/>\nappointment which reads as under:\n<\/p>\n<blockquote><p>     &#8220;You will\tbe on  probation  for  a<br \/>\n     period of\t12 months  from\t date of<br \/>\n     your joining,  which period  may be<br \/>\n     extended from  time to  time at the<br \/>\n     discretion\t  of   the   Management.<\/p><\/blockquote>\n<blockquote><p>     During  the  period  of  probation,<br \/>\n     your  services  may  be  terminated<br \/>\n     without   assigning    any\t  reason<br \/>\n     therefore.&#8221;<\/p><\/blockquote>\n<p>     His service was terminated by proceedings dated January<br \/>\n16, 1991 which reads as under:\n<\/p>\n<blockquote><p>     &#8220;During  the  period  of  probation<br \/>\n     your  work\t performance  was  found<br \/>\n     unsatisfactory.\tTherefore,  your<br \/>\n     services are hereby terminated with<br \/>\n     effect  from  16  Jan.  91\t as  per<br \/>\n     clause  (2)   of  your  appointment<br \/>\n     letter referred to above.&#8221;<\/p><\/blockquote>\n<p>     The petitioner  challenged the  order of termination in<br \/>\nthe High  Court. The  High  Court  without  going  into\t the<br \/>\nquestion whether or not it is stigma, came to the conclusion<br \/>\nthat the  respondents had  totally lost\t confidence  in\t the<br \/>\nappellant and  that he was totally unsuitable to the job for<br \/>\nwhich he  was employed\tand, therefore,\t he  was  found\t not<br \/>\nentitled to any enquiry. Consequently, it dismissed the writ<br \/>\npetition.  Shri\t Sehgal,  learned  senior  counsel  for\t the<br \/>\npetitioner, contends  that the finding recorded amounts to a<br \/>\nstigma; action\ttaken without  conducting enquiry and giving<br \/>\nan opportunity\tto the\tpetitioner, is\tviolative of Article<br \/>\n311(2) of  the Constitution  and the  rules made thereunder.<br \/>\nTherefore, he  is entitled  to an opportunity of being heard<br \/>\nand be dismissed only on the ground of misconduct and not by<br \/>\ntermination simpliciter.  We do\t not agree  with the learned<br \/>\ncounsel. The order may be a motive and not a foundation as a<br \/>\nground for  dismissal. During  the period  of probation, the<br \/>\nauthorities are entitled to assess the suitable to remain in<br \/>\nservice\t they\tare  entitled\tto  record   a\tfinding\t  of<br \/>\nunsatisfactory performance of the work and duties during the<br \/>\nperiod of  probation. Under  these circumstance, necessarily<br \/>\nthe appointing authority has to look into the performance of<br \/>\nthe work  and duties  during the  period of probation and if<br \/>\nthey record a finding that during that probation period, the<br \/>\nwork and performance of the duties were unsatisfactory, they<br \/>\nare entitled to terminate the service in terms of the letter<br \/>\nof appointment without conducting any enquiry. That does not<br \/>\namount to  any stigma. If the record does not support such a<br \/>\nconclusion reached  by the authorities, different complexion<br \/>\nwould arise.  In this  case, they  have recorded the finding<br \/>\nthat the  petitioner was  regularly absent  on one ground or<br \/>\nthe  other.   Under  these  circumstances,  the\t respondents<br \/>\nterminated his\tservices. We  do not  find any illegality in<br \/>\nthe action taken by the respondents.\n<\/p>\n<p>     The special leave petition is accordingly dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Kunwar Arun Kumar vs U.P.
