Advocate\n\nHon'ble Ravindra Singh,J.\n<\/pre>\n<p>Heard learned counsel for the applicant and learned A.G.A.<br \/>\nThis application has been filed with a prayer to quash the the order dated<br \/>\n09.02.2010 passed by the Judicial Magistrate, Ghazipur in Criminal Case No.<br \/>\n1959 of 2008, whereby the applicants have been summoned for the offence<br \/>\npunishable under sections 323, 504, 506, 147, 307 I.P.C.<br \/>\nFrom the perusal of the record, it appears that after considering the complaint,<br \/>\nstatement recorded under Section 202 Cr.P.C. and 202 Cr.P.C., the learned<br \/>\nMagistrate concerned has taken cognizance to summon the applicants vide<br \/>\norder dated 09.02.2010, therefore, the prayer for quashing the same is refused.<br \/>\nHowever, in case the applicant appears before the court concerned within 20<br \/>\ndays from today, N.B.W. issued against the applicant shall be kept in<br \/>\nabeyance.\n<\/p>\n<p>In case the applicant applies for bail, the same shall be heard and disposed of<br \/>\nexpeditiously, if possible, on the same day by the courts below.<br \/>\nWith the above direction, this application is finally disposed of.<br \/>\nOrder Date :- 2.4.2010<br \/>\nSharad\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Abdul Aziz And Others vs State Of U.P.
