NO. 1867 OF 2009\n             = = = = = = = = = = = = = = =\n       Dated this the 30th day of August, 2010.\n\n                     J U D G M E N T\n<\/pre>\n<p>     This appeal is preferred against the interim award<\/p>\n<p>passed in O.P.(MV)1831\/06.          The claimant moved an<\/p>\n<p>application for compensation u\/s 140 of the M.V.Act on<\/p>\n<p>account of the permanent disability suffered.       He was a<\/p>\n<p>passenger in a trekker.     The insurance company of the<\/p>\n<p>trekker raised a contention that being an an Act only policy it<\/p>\n<p>is not liable to pay compensation but the learned Tribunal<\/p>\n<p>had stated that there are several decisions which are to the<\/p>\n<p>effect that even as opposed to an an Act only policy,<\/p>\n<p>passengers of a private car are entitled to support a claim for<\/p>\n<p>compensation.     I am afraid that the said approach is<\/p>\n<p>incorrect. In Swaran Singh&#8217;s case <a href=\"\/doc\/1827019\/\">National Insurance<\/p>\n<p>Co. Ltd. v. Swaran Singh<\/a> (2004 (1) KLT 781) the<\/p>\n<p>Hon&#8217;ble Supreme Court has made it clear these defences are<\/p>\n<p>available to the insurance company even under S.163A<\/p>\n<p>cases. Unless there is a liability on the insurance company it<\/p>\n<p>M.A.C.A. 1867 OF 2009<br \/>\n<span class=\"hidden_text\">                               -:2:-<\/span><\/p>\n<p>cannot be fastened on them arbitrarily. In such cases it will<\/p>\n<p>be for the owner to pay the amount. Therefore I set aside<\/p>\n<p>the award and direct the Tribunal to dispose of the matter<\/p>\n<p>within a period of two months from today after hearing all<\/p>\n<p>concerned.   I make it very clear let the entire O.P. be<\/p>\n<p>disposed of and not the preliminary question.<\/p>\n<p>     Send a copy of the order to the Tribunal for compliance.<\/p>\n<p>                          M.N.
