Petitioners
\n\tare original accused in FIR bearing C.R.No.II-3052 of 2009
\n\tregistered at D.C.B. Police Station, Ahmedabad City on 23.8.2009.
\n\tPursuant to said complaint, investigation was carried out and
\n\tcharge-sheet was already filed. Petitioners seek that reference to
\n\tSection 9 of the Immoral Traffic (Prevention) Act, 1956 be deleted
\n\tsince even as per the allegation of the complaint, ingredients of
\n\tthe said offence are not disclosed.\n<\/p>\n
Counsel
\n\tfor the petitioners drew my attention to order passed on 30thJune,
\n\t2010 passed in Criminal Revision Application no.270 of 2010;
\n\twherein, under identical circumstances, Section 9 came to be deleted
\n\tqua other accused making following observations:\n<\/p>\n
“6.\tOne
\n\tPooja @ Rekha, daughter of Narendra Prakash in her statement
\n\tdated 23.8.2009 had narrated the background under which she was
\n\tdrawn into the prostitution stating inter-alia that her husband was
\n\tnot earning income and had driven her out from her home with her
\n\tchildren. She was struggling to make living in Delhi and that is how
\n\tshe was forced to take up the profession. She thereafter, came to
\n\tAhmedabad about 15 days before the date of incident since she needed
\n\tmoney. She had contacted her friend in Ahmedabad. She thereafter,
\n\tused to entertain customers brought by the accused and others for
\n\twhich they used to charge commission. This in the nutshell is the
\n\tstory. Similar statements have been given by other ladies who were
\n\tfound involved in the said incident.\n<\/p>\n
7.\tQuestion
\n\tis whether ingredients of Section 9 of the Act could be stated to
\n\thave been disclosed. Section 9 reads as follows :\n<\/p>\n
“9.\n<\/p>\n
 Seduction of  a  person  in  custody.-  Any   person  who  having
\nthe custody, charge or care of, or a position of authority over, any
\nperson causes or aids  or abets the seduction for prostitution of
\nthat person shall be  punishable  on conviction with imprisonment of
\neither description for a term which shall not be less than seven
\nyears but which may be for life or for a term  which  may extend to
\nten years and shall also be liable to fine:\n<\/p>\n
 Provided  that  the  Court  may, for adequate and special reasons to be mentioned in the judgment, impose a sentence of imprisonment for a term of  less  than  seven years.”\n<\/p>\n
\t8.\tFrom
\n\tthe perusal of Section 9 of the Act, it is clear that it applies in
\n\ta case where the accused who having the custody, charge or care of,
\n\tor  position of authority over any person, causes or aids or abets
\n\tthe seduction for prostitution of that person. In the present case,
\n\tupon perusal of the evidence collected by the prosecution, I do not
\n\tfind that there is any element of the petitioners being in custody
\n\tor charge or care of any person or in a position of authority over
\n\tsuch person who is drawn into prostitution. To this limited extent,
\n\tthe petitioners are legally correct in contending that whatever be
\n\tthe outcome of the trial, Section 9 of the Act cannot be stated to
\n\thave been involved. Learned Single Judge of this Court in case of
\n\tSureshbhai Prahladbhai Patel v. State of Gujarat<\/a>(supra) made
\n\tfollowing observations :\n<\/p>\n
\t“9.\n<\/p>\n
 It is evident from the above statements that  the
\n       girls  allegedly involved in prostitution did not stay in
\n      hotel Hidway owned by the revisioner.  It is  clear  that
\n      they  were  taken to the hotel by the person through whom
\n      they were engaged, and therefore, it cannot be said  that
\n      they  were  either under custody or charge or care of the
\n      revisioner who happens to be owner  of  the  hotel.    No
\n      other factors are indicated except that revisioner is the
\n      owner  of  the hotel and allegedly he used to charge more
\n      money from the customers and pay less to the  girls,  and
\n      therefore,  there  is  nothing  to  indicate  that he was
\n      enjoying  a  position  of  authority  over   the   girls.
\n      Therefore, the aforesaid ingredients of Section 9 are not
\n      made  out  ,at this stage, even accepting the prosecution
\n      case at its face value.\n<\/p>\n
      9.1\tSection  9  also provides that person who aids or
\n      abets seduction for prostitution  of  that  person  shall
\n      also be punishable.  Term “seduction” has been dealt with
\n      by the   Apex   Court   in  Ramesh  vs.    The  State  of
\n      Maharashtra, AIR<\/a> 1962 SC 1908, wherein  it  was  observed
\n      thus:\n<\/p>\n
      \t” Seducation implies surrender of her body  by  a
\n      woman  who  is otherwise reluctant or unwilling to submit
\n      herself  to  illicit  intercourse   in   consequence   of
\n      persuasion,   flattery,   blandishment   or  importunity,
\n      whether such surrender  is  for  the  first  time  or  is
\n      preceded by  similar surrender on earlier occasions.  But
\n      where a woman offers herself for  intercourse  for  money
\n      not  casually  but  in  the course of her profession as a
\n      prostitute – there are no scruples nor reluctance  to  be
\n      overcome,  and  surrender  by her is not seduction within
\n      the Code.  It would then be impossible  to  hold  that  a
\n      person who instigates another to assist a woman following
\n      the  profession  of  a  prostitute abets him to do an act
\n      with intent that she may or with knowledge that she  will
\n      be seduced to illicit intercourse.”\n<\/p>\n
      9.2\tIn  the light of these observations, the contents
\n      of the statements of the girls, as  discussed  above,  do
\n      not  make  out  a  case  of  seduction either against the
\n      revisioner.\n<\/p>\n
      9.3\tIn  the  opinion  of  this  Court, therefore, the
\n      requirements of Section 9 of the Act  are  not  fulfilled
\n      even after taking the prosecution case, as it is, against
\n      the revisioner.    The  revisioner,  therefore, cannot be
\n      made to face a charge and trial  for  offence  punishable
\n      under Section 9 of the Act.”\n<\/p>\n
9.\tIn
\n\tthe result, petition succeeds to the limited extent of ordering
\n\tdeletion of charge of Section 9 of the Act against the present
\n\tpetitioners from the pending complaint against them”.\n<\/p>\n
Since
\n\tsituations in the present case are identical, Section 9 of the
\n\tImmoral Traffic (Prevention) Act, 1956 is also ordered to be
\n\tdeleted.\n<\/p>\n
Rule
\n\tmade absolute to the aforesaid extent. Direct service.\n<\/p>\n
