SANKARAN,J.\n                            --------------------------------------\n                            W.P.(C) No.17320 of 2008 J\n                            --------------------------------------\n                      Dated this the 16th day of June, 2008.\n\n                                   J U D G M E N T\n<\/pre>\n<p>              The petitioner in this Writ Petition is aggrieved by the non-<\/p>\n<p>consideration of the application submitted by him for the issue of &#8220;No Objection<\/p>\n<p>Certificate&#8221; by the State Government for the purpose of affiliation of his school to<\/p>\n<p>the Central Board of Secondary Education.<\/p>\n<p>              2.     The reliefs prayed for in the Writ Petition are the following:-<\/p>\n<p>                                    (i)       To call for the records<\/p>\n<p>                     relating to Exhibits P-1 to P-4 and to issue a<\/p>\n<p>                     writ of mandamus or any other appropriate<\/p>\n<p>                     writ,  direction      or     order      directing the<\/p>\n<p>                     Respondents 1 and 2 to issue NOC to the<\/p>\n<p>                     Petitioner School &#8211; S.U.M. English School at<\/p>\n<p>                     Olavilam in Kannur District for affiliation to<\/p>\n<p>                     the Central Board of Secondary Education on<\/p>\n<p>                     the basis of the re-submission of the<\/p>\n<p>                     Application       in the light of Exhibit P-3<\/p>\n<p>                     Judgment of this Honourable Court, Apex<\/p>\n<p>                     Court and Exhibit P-1 Order of 1988;\n<\/p>\n<p>WP(C) No.17320\/2008<\/p>\n<p><span class=\"hidden_text\">                                            2<\/span><\/p>\n<p>                                    (ii)  To issue a declaration that<\/p>\n<p>                      the Petitioner School is entitled to get the<\/p>\n<p>                      NOC from the State Government under<\/p>\n<p>                      Article 14 &amp; 19 (g) Constitution of India for<\/p>\n<p>                      affiliation to the CBSE considering the<\/p>\n<p>                      peculiar nature of the locally especially the<\/p>\n<p>                      Muslim majority area;\n<\/p>\n<\/p>\n<p>                                    (iii)       To issue a writ of<\/p>\n<p>                      mandamus or any other appropriate writ,<\/p>\n<p>                      direction or order directing the Respondents 1<\/p>\n<p>                      and 2 to consider Exhibit P-4 Representation<\/p>\n<p>                      submitted by the Petitioner as early as<\/p>\n<p>                      possible at any rate within a stipulated time<\/p>\n<p>                      so as to enable the Petitioner to submit<\/p>\n<p>                      Application for affiliation to the CBSE;<\/p>\n<p>                                    (iv)        To issue any other<\/p>\n<p>                      appropriate writ, order or direction to meet out<\/p>\n<p>                      justice under the circumstances of the above<\/p>\n<p>                      case.&#8221;\n<\/p>\n<\/p>\n<p>             3.       In view of the pendency of Ext.P4 representation before the<\/p>\n<p>first respondent, it is not proper to grant the reliefs other than relief No.(iii).<\/p>\n<p>             4.       The learned Government Pleader submitted that                Ext.P4<\/p>\n<p>representation is not finally disposed of so far. It is also submitted that the<\/p>\n<p>representation submitted by the petitioner would be considered by the first<\/p>\n<p>WP(C) No.17320\/2008<\/p>\n<p><span class=\"hidden_text\">                                         3<\/span><\/p>\n<p>respondent without much delay. The first respondent is legally bound to dispose<\/p>\n<p>of    the representation   in accordance with law.     Therefore I hold that the<\/p>\n<p>petitioner is entitled to    the relief of writ of mandamus directing the first<\/p>\n<p>respondent to dispose of     Ext.P4 representation submitted by him for the issue<\/p>\n<p>of N.O.C.     The first respondent shall dispose of         Ext.P4 representation<\/p>\n<p>submitted by the petitioner for the issue of N.O.C. in accordance with law.<\/p>\n<p>Normally an opportunity of being heard would be afforded to the petitioner; but<\/p>\n<p>the petitioner has waived his right to be heard to facilitate an early disposal of<\/p>\n<p>Ext.P4 representation within a period of one month by the Government. The<\/p>\n<p>petitioner shall produce a copy of the Writ Petition before the first respondent<\/p>\n<p>within a period of ten days for the effective consideration and disposal of Ext.P4<\/p>\n<p>representation submitted by him. The first respondent need not issue notice to<\/p>\n<p>the petitioner before passing the order. The final order shall be passed by the<\/p>\n<p>first respondent within a period of one month. It is made clear that I have not<\/p>\n<p>considered the merits of the case for the grant of &#8220;No Objection Certificate&#8221;.<\/p>\n<p>        The Writ Petition is disposed of as above.<\/p>\n<p>                                                      K.T.
