Justice M.SASIDHARAN NAMBIAR\n\n Dated :08\/12\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.4486 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioners   are  the   accused   and   second<\/p>\n<p>respondent,  the  defacto  complainant  in  C.C.No.<\/p>\n<p>389\/2009 on the file of Additional Chief Judicial<\/p>\n<p>Magistrate&#8217;s   Court,   Thiruvananthapuram,   taken<\/p>\n<p>cognizance for the offences under Sections 451 and<\/p>\n<p>394 of Indian Penal Code on Annexure-I final report<\/p>\n<p>submitted  by  Sub  Inspector  of  Police,  Medical<\/p>\n<p>College Police Station. This petition is filed<\/p>\n<p>under Section 482 of Code of Criminal Procedure to<\/p>\n<p>quash  the  proceedings   contending  that   entire<\/p>\n<p>disputes with the second respondent were settled<\/p>\n<p>amicably.\n<\/p>\n<p>    2. Second respondent appeared through a counsel<\/p>\n<p>and  filed   a   compromise   petition   with   the<\/p>\n<p>petitioners stating that he has settled entire<\/p>\n<p>disputes amicably.\n<\/p>\n<p><span class=\"hidden_text\">CRMC 4486\/10              2<\/span><\/p>\n<p>    3.      Learned counsel  appearing   for    the<\/p>\n<p>petitioners, second respondent and learned Public<\/p>\n<p>Prosecutor were heard.\n<\/p>\n<p>    4. Argument of the learned counsel is that when<\/p>\n<p>entire disputes with the second respondent are<\/p>\n<p>settled, it is not in the interest of justice to<\/p>\n<p>continue the prosecution as held by the Apex Court<\/p>\n<p>in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> (2008 (3)<\/p>\n<p>KLT 19).\n<\/p>\n<p>    5. Learned Public Prosecutor submitted that<\/p>\n<p>first petitioner is involved in twenty criminal<\/p>\n<p>cases and second petitioner is involved in six<\/p>\n<p>cases and all the petitioners are known criminals<\/p>\n<p>and they were in jail under Kerala Anti-Social<\/p>\n<p>Activities (Prevention) Act for six months and<\/p>\n<p>settlement has been procured by threatening the<\/p>\n<p>second respondent.\n<\/p>\n<p>    6. On hearing the learned counsel appearing for<\/p>\n<p>the petitioner and learned Public Prosecutor, I do<\/p>\n<p>not   find    that  offences alleged  against   the<\/p>\n<p><span class=\"hidden_text\">CRMC 4486\/10              3<\/span><\/p>\n<p>petitioners are purely personal in nature so as to<\/p>\n<p>quash the proceedings invoking the principles laid<\/p>\n<p>down in Madan Mohan Abbot&#8217;s case (supra), as sought<\/p>\n<p>for.
