\/>\nHon&#8217;ble\u00a0Krishna\u00a0Murari,\u00a0J.\n<\/p>\n<p>Heard\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0petitioner.\n<\/p>\n<p>Suit\u00a0was\u00a0filed\u00a0by\u00a0the\u00a0plaintiff\u00adpetitioners\u00a0to\u00a0restrain\u00a0the\u00a0defendant\u00ad<\/p>\n<p>respondents\u00a0from\u00a0interfering\u00a0in\u00a0the\u00a0supply\u00a0of\u00a0the\u00a0&#8216;Motor\u00a0Speed&#8217;\u00a0and\u00a0<\/p>\n<p>&#8216;High\u00a0Speed\u00a0Diesel&#8217;.\u00a0An\u00a0application\u00a0for\u00a0temporary\u00a0injunction\u00a0was\u00a0<\/p>\n<p>also\u00a0moved.\u00a0Notices\u00a0were\u00a0issued,\u00a0but\u00a0process\u00a0server\u00a0submitted\u00a0a\u00a0<\/p>\n<p>report\u00a0that\u00a0the\u00a0clerk\u00a0of\u00a0the\u00a0respondent\u00a0corporation\u00a0has\u00a0refused\u00a0to\u00a0<\/p>\n<p>accept\u00a0the\u00a0notices.\u00a0Trial\u00a0court\u00a0vide\u00a0order\u00a0dated\u00a020.11.2009\u00a0finding\u00a0<\/p>\n<p>that\u00a0licence\u00a0issued\u00a0in\u00a0favour\u00a0of\u00a0the\u00a0petitioner\u00a0is\u00a0valid\u00a0till\u00a031st\u00a0March,\u00a0<\/p>\n<p>2010\u00a0and\u00a0the\u00a0agreement\u00a0has\u00a0not\u00a0been\u00a0rescinded\u00a0or\u00a0cancelled\u00a0nor\u00a0<\/p>\n<p>there\u00a0 is\u00a0 any\u00a0violation\u00a0of\u00a0the\u00a0term\u00a0of\u00a0 the\u00a0agreement,\u00a0granted\u00a0 ex\u00a0<\/p>\n<p>parte\u00a0temporary\u00a0injunction.\u00a0Respondent\u00a0no.\u00a03\u00a0went\u00a0up\u00a0in\u00a0appeal,\u00a0<\/p>\n<p>which\u00a0has\u00a0been\u00a0allowed.\n<\/p>\n<p>It \u00a0 is \u00a0 contended \u00a0 by \u00a0 the \u00a0 learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 petitioner \u00a0 that\u00a0<\/p>\n<p>without \u00a0 cancelling \u00a0 the \u00a0 agreement, \u00a0 the \u00a0 defendant\u00adrespondent\u00a0<\/p>\n<p>cannot\u00a0 stop\u00a0 the\u00a0 supply.\u00a0 It \u00a0 has\u00a0 further\u00a0 been\u00a0 contended\u00a0 that\u00a0 the\u00a0<\/p>\n<p>order\u00a0passed\u00a0by\u00a0the\u00a0trial\u00a0court\u00a0was\u00a0in\u00a0exercise\u00a0of\u00a0powers\u00a0conferred\u00a0<\/p>\n<p>by\u00a0Order\u00a039\u00a0Rule\u00a03,\u00a0inasmuch\u00a0as\u00a0the\u00a0order\u00a0was\u00a0passed\u00a0ex\u00a0parte\u00a0<\/p>\n<p>as\u00a0 the\u00a0 defendant\u00adrespondent\u00a0 refused\u00a0 to\u00a0 accept\u00a0 notices\u00a0 and\u00a0 the\u00a0<\/p>\n<p>same\u00a0is\u00a0not\u00a0appealable\u00a0under\u00a0Order\u00a043\u00a0Rule\u00a01\u00a0R.<br \/>\n Prima\u00a0facie,\u00a0there\u00a0appears\u00a0to\u00a0be\u00a0force\u00a0in\u00a0the\u00a0submission\u00a0and\u00a0the\u00a0<\/p>\n<p>matter\u00a0needs\u00a0scrutiny.\n<\/p>\n<p>Issue \u00a0 notice \u00a0 to \u00a0 the \u00a0 respondent \u00a0 no. \u00a0 3, \u00a0 who \u00a0 may \u00a0 file \u00a0 counter\u00a0<\/p>\n<p>affidavit. \u00a0 Petitioner \u00a0 shall \u00a0 take \u00a0 steps \u00a0 for \u00a0 service \u00a0 of \u00a0 notice \u00a0 by\u00a0<\/p>\n<p>registered\u00a0post\u00a0within\u00a0three\u00a0days.\n<\/p>\n<p>Office\u00a0shall\u00a0issue\u00a0notices\u00a0returnable\u00a0within\u00a0six\u00a0weeks.<\/p>\n<p>List\u00a0for\u00a0admission\u00a0after\u00a0service\u00a0of\u00a0notice\u00a0on\u00a0respondent\u00a0no.\u00a03.<\/p>\n<p>The\u00a0record\u00a0further\u00a0indicates\u00a0that\u00a0in\u00a0pursuance\u00a0to\u00a0the\u00a0order\u00a0passed\u00a0<\/p>\n<p>by\u00a0the\u00a0appellate\u00a0court,\u00a019th\u00a0January,\u00a02010\u00a0is\u00a0the\u00a0date\u00a0fixed\u00a0before\u00a0<\/p>\n<p>the\u00a0trial\u00a0court\u00a0for\u00a0consideration\u00a0of\u00a0the\u00a0injunction\u00a0application.\u00a0<\/p>\n<p>The\u00a0trial\u00a0court\u00a0is\u00a0directed\u00a0to\u00a0decide\u00a0the\u00a0injunction\u00a0application\u00a0on\u00a0the\u00a0<\/p>\n<p>said \u00a0 date \u00a0 and \u00a0 if \u00a0 for \u00a0 any \u00a0 reason, \u00a0 the \u00a0 adjournment \u00a0 becomes\u00a0<\/p>\n<p>unavoidable,\u00a0then\u00a0the\u00a0injunction\u00a0application\u00a0shall\u00a0be\u00a0decided\u00a0within\u00a0<\/p>\n<p>two\u00a0weeks\u00a0thereafter.\n<\/p>\n<p>Till\u00a0the\u00a0disposal\u00a0of\u00a0the\u00a0injunction\u00a0application\u00a0as\u00a0directed\u00a0aforesaid,\u00a0<\/p>\n<p>respondent\u00a0no.\u00a03\u00a0shall\u00a0ensure\u00a0regular\u00a0and\u00a0uninterrupted\u00a0supply\u00a0of\u00a0<\/p>\n<p>&#8216;Motor\u00a0Speed&#8217;\u00a0and\u00a0&#8216;High\u00a0Speed\u00a0Diesel&#8217;\u00a0to\u00a0the\u00a0petitioner.<\/p>\n<p>After \u00a0 the \u00a0 decision \u00a0 on \u00a0 the \u00a0 temporary \u00a0 injunction \u00a0 application, \u00a0 the\u00a0<\/p>\n<p>interim\u00a0order\u00a0passed\u00a0above\u00a0shall\u00a0automatically\u00a0stand\u00a0discharged\u00a0<\/p>\n<p>and\u00a0the\u00a0rights\u00a0and\u00a0liabilities\u00a0of\u00a0the\u00a0parties\u00a0shall\u00a0be\u00a0governed\u00a0in\u00a0<\/p>\n<p>accordance\u00a0with\u00a0the\u00a0final\u00a0order\u00a0passed\u00a0on\u00a0the\u00a0temporary\u00a0injunction\u00a0<\/p>\n<p>application.\n<\/p>\n<p>05.01.2010<br
